That the vehicle will be removed by the department <br />seeking removal if a hearing is not timely requested <br />pursuant to Section 21-169 of this chapter. <br /> <br />Notice shall be mailed or delivered in some other manner <br />reasonably calculated to reach the person entitled to notice, <br />if the name and address of the person entitled to notice is <br />ascertainable. Otherwise, notice shall be posted on the <br />vehicle. <br /> <br />SFCTION 21-169. REMOVAL OF VEHICLES HEARING. <br /> <br />Any person entitled to notice under Sections 21-166 or 21-168 of <br />this chapter may request a hearing. The request shall be in <br />writing and filed in the City Manager's office no later than five <br />(5) days after notice was provided. <br /> <br />The hearing shall be held before the city manager or his/her <br />designee within five (5) days of the hearing request. Formal ' <br />rules of evidence shall not apply; however, the parties shall <br />have the right to present evidence, confront and cross- <br />examine witnesses, and receive a written decision based upon <br />the evidence adduced at the hearing. <br /> <br />At the hearing, the city manager or designee shall determine <br />whether removal is or was authorized under Sections 21-165 or <br />21-167 of this chapter. <br /> <br />if removal under Section 21-165 was not authorized, the vehicle <br />shall be released to the owner upon proof of ownership, without <br />payment of removal and storage costs. If removal under <br />Section 21-165 was authorized, the vehicle shall be released to <br />the owner upon proof of ownership and payment of removal <br />and storage costs. <br /> <br />e <br /> <br />If removal sought under Section 21-167 is authorized, the city <br />manager or designee shall order that the the vehicle be <br />removed. If removal under Section 21-167 is not authorized, the <br />city manager or designee shall order that the vehicle not be <br />removed. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, <br />firm or corporation from any penalty heretofore incurred by the violation of <br /> <br /> <br />
