The operator and owner of any vehicle subject to removal <br />under subparagraph 1(a-c) of this section shall be responsible <br />for payment of all removal and storage costs unless the City <br />Manager or his/her designee determines pursuant to Section <br />21-169 of this chapter that removal was not authorized. <br /> <br />The owner of any vehicle subject to removal under <br />subtDaragraphs 1(d-e) or paragraph 2 of this section, and the <br />owner and possessor of the pdvafe property the vehicle was on, <br />shall be responsible for payment of all removal and storage <br />costs unless the City Manager or his/her designee determines <br />pursuant to Section 21-169 of this chapter that removal was not <br />authorized. <br /> <br />Any vehicle subject to removal under this section shall not be <br />removed until-the five (5)-day.period in which to request a <br />removal headng pursuant to Section 21-.169 has expired., unless <br />before then a removal headng is held and the City manager or <br />designee authorizes removal. <br /> <br />The authority granted in this section is in addition to any other <br />authority the Police and Public Works Depadments may have <br />under the law. <br /> <br />SFCTION 21-168. NOTICE OF NONEMERGENCY REMOVAL OF VEHICLES. <br /> <br />Whenever a vehicle is subject to removal pursuant to Section <br />21-167 of this chapter, the department seeking removal shall <br />provide notice to the registered owner of the vehicle, if <br />ascertainable, and if the vehicle is on private property, to the <br />possessor of the private property, if ascertainable. The notice <br />shall provide the following information: <br /> <br />a. A description of the vehicle; and <br /> <br />b. The location of the vehicle; and <br /> <br />That the vehicle is subject to removal and the reason <br />therefor; and <br /> <br />do <br /> <br />The dght to a hearing before removal and the right to be <br />represented by counsel at the hearing; and <br /> <br />e. The procedure for obtaining a hearing; and <br /> <br /> <br />
