Abandoned upon a highway, street, alley, or municipal lot, or left unaHended thereon for more than five (5) days. Parked upon private property and not within a fully enclosed building if the vehicle is inoperable or in violation of state vehicle safety statutes, or does not have current state license plates issued to that vehicle displayed thereon; except that this shall not apply to any vehicle lawfully on the premises of a business lawfully engaged in the sale, repair or storage of such vehicles, provided such parking is necessary to the operation of the business. Parked upon private property and not within a fully enclosed building, and covered with a tarp or other covering in such a manner that all parts of the vehicle are not plainly visible; except that such a vehicle is not subject to removal if, within the time permitted to request a removal hearing under Section 21-169 of this chapter, the person in possession of the private property permits the Police Department to inspect the vehicle and the inspection reveals that the vehicle is not in violation of this section. The Public Works Department is authorized to remove or cause to be removed to a place of safety any vehicle subject to removal under subparagraphs 1(d-e) of this section. If the vehicle is subject to removal under subparagraph l(e), any inspection pursuant thereto may be conducted by the Public Works Depadment. Any vehicle subject to removal under this section is a public nuisance. The operator and owner of any vehicle subject to removal under subparagraphs 1(a-c) of this section shall be in violation of this section and subject to prosecution therefor. The owner of any vehicle subject to removal under subparagraphs 1(d-e) or paragraph 2 of this section, and the owner and possessor of the private property the vehicle is on, shall be in violation of this section and subject to prosecution therefor.
