Abandoned upon a highway, street, alley, or municipal <br />lot, or left unaHended thereon for more than five (5) <br />days. <br /> <br />Parked upon private property and not within a fully <br />enclosed building if the vehicle is inoperable or in <br />violation of state vehicle safety statutes, or does not have <br />current state license plates issued to that vehicle <br />displayed thereon; except that this shall not apply to any <br />vehicle lawfully on the premises of a business lawfully <br />engaged in the sale, repair or storage of such vehicles, <br />provided such parking is necessary to the operation of <br />the business. <br /> <br />Parked upon private property and not within a fully <br />enclosed building, and covered with a tarp or other <br />covering in such a manner that all parts of the vehicle <br />are not plainly visible; except that such a vehicle is not <br />subject to removal if, within the time permitted to request <br />a removal hearing under Section 21-169 of this chapter, <br />the person in possession of the private property permits <br />the Police Department to inspect the vehicle and the <br />inspection reveals that the vehicle is not in violation of this <br />section. <br /> <br />The Public Works Department is authorized to remove or cause <br />to be removed to a place of safety any vehicle subject to <br />removal under subparagraphs 1(d-e) of this section. If the <br />vehicle is subject to removal under subparagraph l(e), any <br />inspection pursuant thereto may be conducted by the Public <br />Works Depadment. <br /> <br />Any vehicle subject to removal under this section is a public <br />nuisance. <br /> <br />The operator and owner of any vehicle subject to removal <br />under subparagraphs 1(a-c) of this section shall be in violation <br />of this section and subject to prosecution therefor. <br /> <br />The owner of any vehicle subject to removal under <br />subparagraphs 1(d-e) or paragraph 2 of this section, and the <br />owner and possessor of the private property the vehicle is on, <br />shall be in violation of this section and subject to prosecution <br />therefor. <br /> <br /> <br />
