to the room or rooms in which intoxicating liquor is dispensed; and where such <br />licenses are held by restaurants whose business is conducted in one room only and <br />substantial quantities of food and merchandise other than intoxicating liquors are <br />dispensed, then the licensee shall keep securely locked dudrig the hours and on days <br />specified in this section all refrigerators, cabinets, cases, boxes, and taps from which <br />intoxicating liquor is dispensed. <br /> <br />(3) <br /> <br />A 'closed place" is defined to mean a place where all doors are locked and where <br />no patrons are in the place or about the premises. <br /> <br />(4) <br /> <br />Nothing in this section shall be construed to prohibit the sale or delivery of any <br />intoxicating liquor during any of the hours or on any of the days specified in this <br />section by a wholesaler licensed under the provisions of Section 311.180 RSMo to a <br />person licensed to sell the intoxicating liquor at retail. <br /> <br />(5) <br /> <br />When January first, March seventeenth, July fourth, or December thirty-first falls on <br />Sunday, and on Sundays prior to Memorial Day and Labor Day and on the Sunday <br />on which the national championship game of national football league is played, <br />commonly known as 'Super Bowl Sunday", any person having a license to sell <br />intoxicating liquor by the drink may be open for business and sell intoxicating liquor <br />by the drink under the provisions of the license on that day from the time and until <br />the time which would be lawful on another day of the week, notwithstanding any <br />provisions of law to the contrary. <br /> <br />(6) <br /> <br />Any person licensed to sell intoxicating liquor under this article, who is licensed under <br />the provisions of Section 311.097 RSMo (restaurant bar) or 311.293 RSMo (package <br />liquor) to sell intoxicating liquor between the hours of 11:00 a.m. and midnight on <br />Sunday, or who is licensed under the provisions of Section 311.090 RSMo (certain tax- <br />exempt organizations) to sell intoxicating liquor between the hours of 11:00 a.m. and <br />midnight on Sunday and is a music school licensed pursuant to Section 4-7(3)(d)(i), <br />may apply to the finance director for a license to sell intoxicating liquor on Sunday. <br />A licensee under this subsection shall pay to the finance director an additional fee <br />of $300 a year for the privilege of selling intoxicating liquor on Sunday, payable at the <br />same time and in the same manner as its other license fees. <br /> <br />(7) <br /> <br />Any person licensed to sell intoxicating liquor on Sunday pursuant to subsection 6 of <br />this section may be open for business and sell intoxicating liquor between 1:00 p.m. <br />and midnight on Sunday, notwithstanding any provisions of law to the contrary. <br /> <br /> Section ?. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Sections 4-7, 4-8 or 4- <br />22, nor bar the prosecution for any such violation. <br /> <br /> <br />
