to the room or rooms in which intoxicating liquor is dispensed; and where such licenses are held by restaurants whose business is conducted in one room only and substantial quantities of food and merchandise other than intoxicating liquors are dispensed, then the licensee shall keep securely locked dudrig the hours and on days specified in this section all refrigerators, cabinets, cases, boxes, and taps from which intoxicating liquor is dispensed. (3) A 'closed place" is defined to mean a place where all doors are locked and where no patrons are in the place or about the premises. (4) Nothing in this section shall be construed to prohibit the sale or delivery of any intoxicating liquor during any of the hours or on any of the days specified in this section by a wholesaler licensed under the provisions of Section 311.180 RSMo to a person licensed to sell the intoxicating liquor at retail. (5) When January first, March seventeenth, July fourth, or December thirty-first falls on Sunday, and on Sundays prior to Memorial Day and Labor Day and on the Sunday on which the national championship game of national football league is played, commonly known as 'Super Bowl Sunday", any person having a license to sell intoxicating liquor by the drink may be open for business and sell intoxicating liquor by the drink under the provisions of the license on that day from the time and until the time which would be lawful on another day of the week, notwithstanding any provisions of law to the contrary. (6) Any person licensed to sell intoxicating liquor under this article, who is licensed under the provisions of Section 311.097 RSMo (restaurant bar) or 311.293 RSMo (package liquor) to sell intoxicating liquor between the hours of 11:00 a.m. and midnight on Sunday, or who is licensed under the provisions of Section 311.090 RSMo (certain tax- exempt organizations) to sell intoxicating liquor between the hours of 11:00 a.m. and midnight on Sunday and is a music school licensed pursuant to Section 4-7(3)(d)(i), may apply to the finance director for a license to sell intoxicating liquor on Sunday. A licensee under this subsection shall pay to the finance director an additional fee of $300 a year for the privilege of selling intoxicating liquor on Sunday, payable at the same time and in the same manner as its other license fees. (7) Any person licensed to sell intoxicating liquor on Sunday pursuant to subsection 6 of this section may be open for business and sell intoxicating liquor between 1:00 p.m. and midnight on Sunday, notwithstanding any provisions of law to the contrary. Section ?. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Sections 4-7, 4-8 or 4- 22, nor bar the prosecution for any such violation.
