BILL NO. INTRODUCED BY COUNCILMEMBER WARE 8305 ORDINANCE NO. 6087 AN ORDINANCE AMENDING CHAPTER 1 OF THE MUNICIPAL CODE OF UNIVERSITY CITY, RELATING TO GENERAL PROVISIONS, BY REPEALING SECTION 1-8.2 THEREOF, RELATING TO ASSESSMENT OF SPECIAL COURT COSTS, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 1-8.2. ASSESSMENT OF SPECIAL COURT COSTS," BY AMENDING SAID SECTION SO AS TO PROVIDE FOR THE ASSESSMENT OF COURT COSTS TO BE PAID TO THE STATE MOTORCYCLE SAFETY FUND; CONTAINING A SAVINGS CLAUSE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 1 of the Municipal Code of the City of University City, relating to general provisions, is hereby amended by repealing Section 1-8.2 thereof, relating to assessment of special court costs, and enacting in lieu thereof a new section to be known as "Section 1-8.2, Assessment of Special Court Costs, "relating to the ,same subject, so that said section, as so amended, shall read as follows: SECTION 1-8.9. ASSESSMENT OF SPECIAL COURT COSTS (a) In addition to all other court costs: (1) A fee of five dollars ($5.00) shall be assessed as court costs against a defendant in each court proceeding for violation of a municipal ordinance except that no such fee shall be collected for any non-moving traffic violations, except violations of weight limit and safety laws, and no such fee shall be collected when the proceeding or the defendant has been dismissed by the court or when costs are to be paid by the City on behalf of an indigent defendant. The clerk of the municipal court shall collect such court costs. (2) At least monthly, ninety-five percent (95%) of the court costs collected by the municipal court clerk pursuant to paragraph (a)(1) shall be paid to the Missouri Director of Revenue for the crime victims' compensation fund and the services to victims fund, and the remaining five percent (5%) shall be paid into the City treasury.
