months after the Start of Construction; provided that the time <br />for completion shall be extended for delays beyond the control of <br />Developer including, but not limited to, acts of God, inclement <br />weather, strikes, inability to procure or a general shortage of <br />labor, equipment, facilities, materials, or supplies, lockouts, <br />acts of labor unions, condemnation, court orders, laws, or orders <br />of governmental or military authorities. <br /> <br />3.2.1 Construction Contracts. In constructing or <br />causing the construction of the Work, the Developer may <br />enter into one or more construction contracts to complete <br />the Work. Prior to execution of any construction contract, <br />Developer shall provide satisfactory documentation to the <br />City evidencing limitation of any recourse of any such <br />contractor against the City to the Special Allocation Fund <br />or to any mechanic's lien rights against the Property. <br /> <br />Prior to the commencement of construction of the Work, the <br />Developer shall obtain or shall ensure that any such <br />contractor obtains workers' compensation, comprehensive <br />public liability and builder's risk insurance coverage in <br />amounts customary in the industry for similar type projects. <br />Prior to commencement of construction, Developer shall <br />deliver to the City evidence of all insurance to be <br />maintained by such contractor as required by this <br />subparagraph. Developer shall ensure that the insurance <br />required is maintained by any such contractor for the <br />duration of the construction of the Work. <br /> <br />3.2.2 Construction Plans. The Concept Site Plan is <br />hereby approved. Within 180 days following the execution of <br />this Agreement, Developer shall submit for approval by the <br />City Construction Plans in sufficient completeness and <br />detail to show that construction will be in general <br />conformance with the Concept Site Plan and in accordance <br />with the provisions of the Redevelopment Plan and this <br />Agreement. The Construction Plans shall be prepared by a <br />design professionals licensed to practice in the State of <br />Missouri. Construction Plans and all construction practices <br />and procedures with respect to the Work shall be in <br />conformity with all applicable state and local laws, <br />ordinances, and regulations. <br /> <br />3.2.3 Changes. During the progress of the Work, <br />Developer may make such reasonable changes, including, <br />without limitation, modification of the construction <br />schedule, including dates of commencement and completion, <br />modification of the areas in which the Work is to be <br />performed, relocation, expansion or deletion of items, and <br />any and all such other changes as site conditions or orderly <br /> <br /> -- 8 -- <br /> <br />STL-535046 <br /> <br /> <br />
