provided in the TIF Act) and paid into the Special Allocation <br />Fund but excluding therefrom any taxes imposed on sales or <br />charges for sleeping rooms paid by transient guests of hotels and <br />motels, licenses, fees or special assessments and personal <br />property taxes, other than payments in lieu of taxes.~he yearly <br />payments in lieu of taxes shall be prorated on the basis of 30~ <br />days to the month). <br /> <br /> "Work": All work necessary to prepare the Property and to <br />implement the Redevelopment Project including, but not limited to <br />relocation in accordance with the Redevelopment Policy of the <br />residents and businesses on the Property; construction of public <br />improvements; demolition and removal of all existing buildings <br />and improvements located on the Property, clearing and grading of <br />the Property, relocation of existing utilities, construction of <br />retaining structures, and installation of stormwater control and <br />detention facilities, all as necessary to prepare the Property <br />for commencement of construction; and construction on the <br />Property of a retail shopping center which is composed of a <br />grocery store containing approximately 62,000 square feet and <br />additional retail space containing approximately 18,000 square <br />feet but excluding the development of outparcels, all as depicted <br />in the Concept Site Plan and in accordance with the Redevelopment <br />Proposal. <br /> <br /> "Zoning Approvals": All plat approvals, re-zoning or other <br />zoning changes, site plan approvals, conditional use permits, or <br />other subdivision, zoning, or similar approvals required for the <br />implementation of the Redevelopment Project and consistent with <br />the Redevelopment Plan. <br /> <br />ARTICLE II. ACCEPTANCE OF PROPOSAL <br /> <br /> 2.1 Developer Designation. The City hereby accepts the <br />Redevelopment Proposal and designates Developer to acquire the <br />Property and to perform the Work in accordance with the <br />Redevelopment Plan and the Redevelopment Project and as provided <br />in this Agreement. <br /> <br /> 2.2 Developer to Advance Costs. Developer agrees to <br />advance all Eligible Redevelopment Project Costs as necessary to <br />acquire the Property and to complete the Work, all subject to <br />Developer's right to abandon the Redevelopment Project and <br />terminate this Agreement as set forth in paragraph 7.1 of this <br />Agreement. Additionally, Developer shall advance to the City the <br />total sum of up to $30,000.00 to pay such Redevelopment Project <br />Costs incurred by the City prior to the date of issuance of any <br />TIF Notes, which sum shall be advanced contemporaneously with the <br />execution of this Agreement.
