( CHAPTER 34 EXISTING STRUCTURES ) (SECTION 3408.0 COMPLIANCE ALTERNATIVES) 3408.2 Applicability: Structures existing prior to July 15, 1963 in which there is work involving additions, alterations or changes of occupancy, shall be made to conform to the requirements of this section or the provisions of Sections 3403.0 through 3407.0. The provisions in Sections 3408.2.1 through 3408.2.5 shall apply to existing occupancies that will continue to be or are proposed to be, in Use Groups A, B, E, F, M, R and S. These provisions shall not apply to buildings with occupancies in Use Group H or I. (CHAPTER 35 REFERENCED STANDARDS) CODES Reference IPC-97 International Plumbing Code instead of IPC-95 with 1996 Supplement. Section 2. Saving Clause. Nothing in this ordinance or in the Building Code, including, the referenced codes and standards listed in Chapter 35 of the Building Code, hereby adopted, shall be construed to affect any suit or proceeding pending in any court, or any rights acquired or liability incurred, or any cause or causes of a~tion acquired or existing under any act or ordinance hereby repealed, as cited herein. Section 3. Severability. If any section, subsection, provision, sentence, clause or phrase of this ordinance or of the BOCA National Building Code, Thirteenth Edition, 1996, including, the referenced codes and standards listed in Chapter 35 of the Building Code, is for any reasons held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this ordinance or of said code and supplement, and the City Council of the City of University City, Missouri hereby declares that it would have passed the same, even though such portion so held to be unconstitutional had not been included herein, and to this end the provisions of this ordinance are hereby declared to be severable. Section 4. Penalty. Any person, firm or corporation violating any provisions of this ordinance or the code hereby adopted, shall upon conviction thereof be subject to the penalties provided in Section 1-8 of the Municipal Code of the City of University City, Missouri. Section 5. Effective Date. passage, as provided by law. CITY CLERK This ordinance shall take effect and be in force from and after its C-81dg. AG7 June 12, 1997 -17-
