Sec 17-2. ADDITIONS, INSERTIONS, DELETIONS AND CHANGES <br /> <br />The following numbered sections and sub-sections of the BOCA Property <br />Maintenance Code, Fifth Edition, 1996, are hereby amended by additions, <br />insertions, deletions and changes so that such amended sections and subsections <br />shall read as follows: <br /> <br />(CHAPTER 1 ADMINISTRATION AND ENFORCEMENT) <br /> <br />(SECTION PM-101.0 GENERAL) <br /> <br />PM-101.1 Title: These regulations shall be known as the Property Maintenance Code of the <br />City of University City, Missouri, hereinafter referred to as this code. <br /> <br />PM-101.2 Scope: This code is to protect the public health, safety and welfare in all existing <br />structures, residential and nonresidential, and on all existing premises and exterior properly by <br />establishing minimum requirements and standards for premises, structures, exterior property, <br />equipment, and facilities for light, ventilation, space, heating, sanitation, protection from the <br />elements, life safety, safety from fire and other hazards, and for safe and sanitary maintenance; <br />fixing the responsibility of owners, operators, and occupants; regulating the occupancy of <br />existing structures and premises and providing for administration, enforcement and penalties. <br /> <br />PM-101.8 Historic Structures: Where carrying out the provisions of this code will significantly <br />alter the histodc or architectural character of an existing structure that has been officially <br />designated by the State of Missouri or by the City of University City as a historic building, <br />property or landmark, the code official upon application of the owner or the owner's <br />representative, shall vary, modify orwaive the such provisions based on a finding that the public <br />interest in health, safety and welfare will be served by such action. <br /> <br /> (SECTION PM-104.0 APPROVAL) <br />PM-t04.2.1 Records:-Delete in its entirety. <br /> <br />(SECTION PM-105.0 DUTIES AND POWERS OF CODE OFFICIAL) <br /> <br />PM-105.3.1 Search warrants: <br /> <br />1. A search warrant may be issued by the municipal judge commanding the search of a <br />structure or premises within the territorial jurisdiction of the city and municipal judge to search <br />and seize, or photograph, copy or record any property, structure or premises which are in or <br />used in or used in violation of this chapter. <br /> <br />2. The code official or any peace officer may make application for the issuance of a search <br />warrant. The application shall: (1) Be in wdting; <br /> (2) State the time and date of the making of the application; <br /> (3) Identify the structure or premises which are to be searched in sufficient detail <br /> and particularity that the code official or peace officer executing the warrant can <br /> readily ascertain the structure or premises; <br /> (4) Identify the place or thing which is be be searched, in sufficient detail and <br /> particularity that the code official or peace officer executing the warrant can <br /> readily ascertain what he/she is to search; <br /> (5) State facts sufficient to show probable cause for the issuance of a search <br /> warrant. <br /> (6) Be vedfied by the oath or affirmation of the applicant; <br /> <br />-2- <br /> <br /> <br />
