06/04/63 <br /> <br />618.080 <br /> <br />General Testing. <br /> <br /> (I) When not otherwise provided by Law, the Supervisor, the Chief Inspector and the inspectors <br />shall have the power to inspect and test, to ascertain if they are correct, all weights and measures kept, <br />offered or exposed for sale. <br /> <br /> (2) It shall be the duty of the Supervisor at least armually and as much oftener as he may deem <br />necessary, to inspect and to test or cause to be inspected and tested, in order to ascertain if they are correct, <br />all weights and measures commercially used (a) in determining the weight, measure, charge, or count of <br />commodities or fixhags sold or offered or exposed for sale, or leased, on the basis of weight or of measure, <br />(b) in computing the basic charge for services rendered on the basis of weight or of measure, or (e) in <br />determining the weight or measure when a charge is made for such determination; provided, that with <br />respect to single-service devices designated to be used commercially only once and then to be discarded, <br />and with respect to devices uniformly mass-produced by means of a mold or die and not susceptible to <br />individual adjustment, the inspection and testing of each individual device shall not be required and the <br />inspection and testing requirements of this section will be satisfied when inspections and tests are made on <br />representative sample lots of said devices; the larger lots of which such sample lots are representative shall <br />be held to be correct or incorrect, upon the basis of the results of the inspections and tests on such sample <br />lots. <br /> <br />618.090 Investigation. The Supervisor shall investigate complaints made to him concerning <br />violations of the provisions of this Ordinance and shall, upon his own initiative, conduct such investigations <br />as he deems appropriate and advisable to develop information upon prevailing procedures in commercial <br />quantity determination and on possible violations of the provisions of this Ordinance, and to promote the <br />general objective of accuracy in the determination and representation of quantity in commercial transactions. <br /> <br />618.100 Right of Entry or Inspection. The Supervisor, the Chief Inspector and the inspectors, in <br />the performance of their official duties, are authorized to enter and go into or upon, without formal warrant, <br />any structure or premises or vehicle for the purpose of examining and testing weights and measures and <br />commodities as prescribed by this Ordinance. No person shall fail or refuse to have any instrument of <br />weight or measurement or commodity in his possession for his use examined, tested, corrected, or sealed <br />when called upon for that purpose by the Supervisor or any of his assistants, and no such weight or measur~ <br />shall be deemed inspected, tested or sealed until an owner or owners thereof shall have obtained a proper <br />certificate or license from the Supervisor of Weights and Measures. <br /> <br />618.110 Inspection of Packages. The Supervisor shall from time to time, weigh or measure and <br />inspect packages or amounts of commodities kept, offered, or exposed for sale, sold, or in the process of <br />delivery, to determine whether the same contain the amounts represented and whether they shall be kept, <br />offered, or exposed for sale, or sold, in accordance with law; and when such packages or amounts of <br />commodities are found not to contain the amounts represented or are found to be kept, offered, or exposed <br /> <br />v~rrAO..4 <br /> <br /> <br />
