carrying, conveying or transporting goods, wares, merchandise, garden truck farm <br />products or provisions, beverages, meats, fish, vegetables, fruits or other food, <br />offering and exposing the same for sale, or making sales and delivering articles to <br />purchasers, or who, without traveling firom place to place, shall sell or offer the same <br />for sale from a wagon, cart, railroad car, motor vehicle or other vehicle or <br />conveyance, or a temporary stand, and further provided that one who solicits orders <br />and as a separate transaction makes deliveries to purchasers as part of a scheme or <br />design to evade the provisions of this article shall be deemed a peddler subject to the <br />provisions of this article. The word "peddler" shall include the words "hawker" and <br />"huckster." <br /> <br />Section 18-59. License-Required. <br /> <br />It shall be unlawful for any person to carry on the business of a peddler or hawker in <br />the city unless the person has a license issued therefor by the City Manager or his <br />designee. <br /> <br />B. No license to carry on such business shall be issued unless: <br /> <br />The applicant is a charitable or religious organization exempt from taxation <br />under Section 501(c)(3) of the Internal Revenue Code; <br /> <br />The application includes the following: <br />a. The name, address and telephone number of the applicant; <br />b. Proof of the applicant's tax exempt status; <br />c. A list or description of the items which will be sold or offered for sale; <br />d. A sketch drawing of the location where the items will be sold or offered <br /> for sale indicating the proposed arrangement on said property; <br />e. The date and time when the items will be sold or offered for sale; <br />f. Proof of the applicant's right to be on the premises where the items will <br /> be sold or offered for sale; <br />g. Any other information deemed relevant by the City Manager or his <br /> designee; <br /> <br />3. The required license fee is paid; <br /> <br />The items will be sold or offered for the sale by the applicant upon premises <br />lawfully occupied by a business licensee under this chapter; and such items <br />can be lawfully sold on the premises by the business licensee; and the items <br />will be sold or offered for sale only during the hours the business is open to <br />the public for business; <br /> <br />During the preceding 12 months the applicant has not been permitted to carry <br />on the business of a peddler or hawker more than four times under a different <br />license issued for each time. <br /> <br /> <br />
