BILL NO. <br /> <br />~ ~ 5~ ORDINANCE NO. <br /> <br /> AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br /> THE CITY OF UNIVERSITY CITY, MISSOURI, RELATING TO <br /> ZONING, BY REPEALING SECTION 34-57.3 THEREOF, RELATING TO <br /> ELEVATOR APARTMENT BUILDINGSAND ENACTING IN LIEU THEREOF <br /> A NEW SECTION 34-57.3, "ELEVATOR APARTMENT BUILDINGS," SO <br /> AS TO AMEND SAID SECTION RELATING TO DEVELOPMENT LOCATION <br /> AND RELATING TO MINIMUM BUILDING SETBACKS; BY REPEALING <br />.SECTION 34-57.4, RELATING TO COMMON OPEN SPACE REQUIRE- <br /> MENTS FOR RESIDENTIAL DEVELOPMENTS, AND ENACTING IN LIEU <br /> THEREOF A NEW SECTION TO BE KNOWN AS SECTION 34-57.4, <br /> "COMMON OPEN SPACE REQUIREMENTS FOR RESIDENTIAL <br /> DEVELOPMENTS" SO AS TO AMEND SAID SECTION RELATING TO THE <br /> STANDARD FOR DEVELOPMENTS IN THE HIGH DENSITY RESIDENTIAL <br /> OR THE HIGH DENSITY RESIDENTIAL/OFFICE DISTRICTS, <br /> RELATING TO THE MINIMUM AREA FOR COMMON OPEN SPACES AND <br /> RELATING TO OTHER REQUIREMENTS FOR SUCH COMMON OPEN <br /> SPACES; CONTAINING SAVING CLAUSEAND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of <br />University City, Missouri (Zoning Code) divides the City of <br />University City (City) into several zoning districts, and regulates <br />the character of buildings which may be erected in said districts, <br />and the uses to which the buildings and premises located therein <br />may be put; and <br /> <br /> WHEREAS, the City Plan Commission has examined amendments to <br />Sections 34-57.3 and 34-57.4; and <br /> <br /> 'WHEREAS, the Plan Commission, at a meeting held at City Hall <br />on March 25, 1998, at 7:30 p.m., approved amendments to said <br />Sections of the Zoning Code and recommended to the City Council <br />that said amendments be enacted into an ordinance; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City <br />Council in the City Council Chambers at City Hall on May 4, 1998 at <br />7:30 p.m., was duly published in the St. Louis Countian, a <br />newspaper of general circulation within the City, on April 18, <br />1998; and <br /> <br /> WHEREAS, said public hearing was held at the time and place <br />specified in said notice, and all suggestions or objections <br />concerning said amendments to said Sections of the Zoning Code were <br />duly heard and considered by the City Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> SECTION 1: Chapter 34 of the Municipal Code of the City of <br />University City, Missouri, relating to zoning, is hereby amended by <br />repealing Section 34-57.3 thereof., relating to elevator apartment <br /> <br /> <br />
