Residential or "HRO" - High Density Residential/Office <br />District under conditional use permit review per <br />Article 11 of the Zoning Code. <br /> <br />C · <br /> <br />To the extent practicable, common open spaces should be <br />distributed equitably throughout the development in <br />relation to the dwelling units which such common open <br />spaces is intended to serve. The open space shall not be <br />isolated in one corner of a development, but shall be <br />highly accessible (physically and/or visually) to the <br />residents of the development. These standards may be <br />waived in the "HR" - High Density Residential or "HRO" - <br />High Density Residential/Office District under condi- <br />tional use permit review per Article 11 of the Zoning <br />Code. <br /> <br />o <br /> <br /> Where common open space is to be provided in a subdivided <br /> residential development, the use, operation, and maintenance <br /> of areas for common open space, common ground, and common <br /> buildings shall be guaranteed by the establishment of a trust <br />'indenture as required in Section 29-35, "Subdivision and Land <br /> Development Code," Chapter 29, University City Municipal Code. <br /> <br /> SECTION 3: This ordinance shall not be construed so as to <br />relieve any person, firm or corporation from any penalty incurred <br />by the violation of Sections 34-57.3 or 34-57.4, nor bar the <br />prosecution of any such violation. <br /> <br /> SECTION 4: Any person, firm or corporation violating any of <br />the provisions of this ordinance shall, upon conviction thereof, be <br />subject to the penalties provided in Chapter 34 and in Chapter 1, <br />Section 1-8 of the Municipal Code of the City of University City. <br /> <br /> SECTION 5: This ordinance shall take effect and be in force <br />from and after its passage, as provided by law. <br /> <br /> PASSED this /~ day of //~ ~~ , 1998. <br /> <br />AT~E~ i ' .
