AN ORDINANCE AUTHORIZING TI-[E PUBLIC IMPROVEMENT OF <br />DELCREST COURT BY REMOVING AND REPLACING THE EXISTING <br />STREET PAVEMENT; AUTHORIZING THE CITY TO ENTER INTO A <br />CONTRACT WITH SOUTHARD CONSTRUCTION COMPANY FOR THE <br />IMPROVEMENT WORK; AND AUTHORIZING THE CITY MANAGER TO <br />ENTER INTO AND EXECUTE ON BEHALF OF THE CITY SUCH CONTRACT <br />AND ALL OTHER DOCUMENTS IN CONNECTION THEREWITH; <br />CONTAINING AN EMERGENCY CLAUSE. <br /> <br /> WHEREAS, on June 8, 1998, the City Council adopted a resolution declaring the necessity <br />of making a public improvement of Delcrest Court, a street in University City, Missouri, by removing <br />and replacing existing street pavement; and <br /> <br /> WHEREAS, upon the adoption of said resolution, the City Council fixed June 29, 1998 at <br />7:30 p.m., as the date and time for a public hearing at City Hall with respect to such public <br />improvement; and <br /> <br /> WHEREAS, due notice of the public hearing was duly published in the St. Louis Countian, <br />a newspaper of general circulation within the City, on June 17, 1998; and <br /> <br /> WHEREAS, on June 29, 1998, at 7:30 p.m., the public hearing was lawfully held by the City <br />Council in the City Council Chambers at City Hall, and all persons interested in the public <br />improvement were heard; and <br /> <br /> WHEREAS, apter the public hearing, the City Council determined that such public <br />improvement is in the public interest and decided to proceed with the public improvement, and <br />directed the City Manager to cause plans and specifications for the public improvement to be <br />prepared by the proper officer and submitted to the City Council for approval; and <br /> <br /> WHEREAS, the City advertised for bids to perform the work necessary under such plans and <br />specifications; and <br /> <br />WHEREAS, such bids were properly received and considered. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. The City of University City, Missouri, is hereby authorized to make a public <br />improvement of Delcrest Court, a street in University City, Missouri, by removing and replacing <br />existing street pavement. <br /> <br /> <br />
