Section 2. The City Council determines and finds that Southard Construction Company <br />is the lowest responsible bidder for the necessary work. <br /> <br /> Section 3. The City is hereby authorized to enter into the attached "Improvement <br />Contract for Project No. 917," marked Exhibit "A" and made a part hereof. The City Manager is <br />hereby authorized to enter into and execute on behalf of. the City said contract and all other <br />documents in connection therewith. <br /> <br /> Section 4. The "whole cost" of the public improvement is approximately $32,515.00, <br />including all expenses incurred by the City for surveys, plans, engineering services, etc. All of the <br />final whole cost shall be paid for by a special tax or assessment levied against a benefit district which <br />shall include all real property owned by Delcrest Condominium Ltd. and its members, which is located <br />at Nos. 1, 2, 3, 4 and 5 Delcrest Court, University City, Missouri, including the 40 condominium units <br />there. The percentage of the final whole cost to be assessed against and levied upon each <br />condominium unit shall be the unit owner's corresponding percentage of ownership in the common <br />elements as a tract, and special tax bills evidencing such assessment shall be issued. <br /> <br /> Section 5. The boundaries of the benefit district are set forth in the following legal <br />description of the condominium property: <br /> <br /> Lot 5 and Part of Lot 6 of Delcrest, as per plat thereof recorded in Plat Book 45, Page 46, <br />of the St. Louis County Records and said Lot 5 and part of 6 being more particularly described as <br />follows: <br /> <br /> Beginning in the south line of Delcrest Drive, 60 feet wide, at the northeast corner of Lot 5; <br />thence north 12 degrees-- 44 minutes -- 30 seconds west a distance of 337.73 feet to a point; thence <br />south 54 degrees -- 30 minutes west a distance of 569.42 feet to a point; thence north 11 degrees <br />-- 41 minutes east a distance of 671.70 feet to a point on the south line of Delcrest, 60 feet wide; <br />thence east along said south line an arc distance of 43.95 feet curving to the left and having a radius <br />of 822.00 feet to a point of compound curvature; thence continuing eastwardly along said south line <br />an arc distance of211.05 feet curving to the left and having a radius of 594.00 feet to the point of <br />beginning and containing 3.93 acres more or less. <br /> <br /> Section 6. An emergency is hereby declared to exist in that the construction contract must <br />be awarded immediately in order for the work to be completed in a timely manner this year. <br /> <br /> Section 7. <br />provided by law. <br /> <br />This ordinance shall take effect and be in force from and after its passage as <br /> <br />PASSED this ~ day of <br /> <br /> <br />
