BILL NO. ~)q/C~ __ ORDINANCE NO. ¢ 1615'~ <br /> <br />AN ORDINANCE LEVYING A SPECIAL ASSESSMENT OR TAX AGAINST <br />PROPERTY IN A BENEFIT DISTRICT FOR THE PUBLIC IMPROVEMENT <br />OF DELCPd:~ST COURT BY REMOVING AND REPLACING THE STREET <br />PAVEMENT, AND DIRECTING THE ISSUANCE OF SPECIAL TAX BILLS. <br /> <br /> WHEREAS, On June 8, 1998, the City Council adopted a resolution declaring the <br />necessity of making a public improvement of Delcrest Court, a street in University City, <br />Missouri, by removing and repla~ing existing street pavement; and <br /> <br /> WHEREAS, after a public hearing on June 29, 1998, the City Council determined that <br />such public improvement was in the public interest and decided to proceed with the public <br />improvement, and d rected the City Manager to cause plans and specifications for the public <br />improvement to be t.repared by the proper officer and submitted to the City Council for approval; <br />and <br /> <br /> WHEREAS The City advertised for bids to perform the work necessary under such <br />plans and specificati OhS, and such bids were properly received and considered; and <br /> <br /> WHEREAS the contract for the public improvement was let to the lowest responsible <br />bidder, and the contract was formally executed by Sourhard Construction Company and the City <br />Manager; and <br /> <br />WHEREAS. the public improvement was made pursuant to Ordinance No. 6175; and <br /> <br />g~IEREAS. the final whole cost of the public improvement is $36,063.84; and <br /> <br />WHEREAS. the total cost to the property owners in the benefit district is $36,063.84. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Tire City Council determines and finds that the public improvement of <br />Delcrest Court, a street in University City, Missouri, by removing and replacing the street <br />pavement, has been completed, and that the final whole cost of the public improvement is <br />$36.063.84. <br /> <br /> Section 2. A special assessment or tax in the total amount of $36,063.84 is hereby levied <br />and assessed against dl real property owned by Delcrest Condominium Ltd. and its members, <br />which is located at N)s. 1, 2, 3, 4 and 5 Delcrest Court, University City, Missouri, including the <br />40 condominium units there. The percentage of the final whole cost assessed and levied upon <br />each condominium m rit is the unit owner's corresponding percentage of ownership in the <br />common elements as a tract, as shown on the attached document marked Exhibit "A" and made a <br />part hereof. <br /> <br /> Section 3. The boundaries of the benefit district are set forth in the folloxving legal <br />description of the condominium property: <br /> <br />Lot 5 and Part of Lot 6 of Delcrest, as per plat thereof recorded in Plat Book 45.
