to the employee's retirement under Section 2.62.080(A) or (E) a monthly benefit of twenty-five (25) <br />percent of the monthly base salary in effect at the date of the employee's retirement or at the employee's <br />death until the death or remarriage of such surviving spouse, <br /> 2. To the lawful guardian of such employee's surviving minor unmarried child or children <br />under the age of eighteen (18) years, provided such child or children shall have been born within <br />ten months after the employee's retirement or the employee's death in service, a monthly benefit of ten <br />percent of the monthly base salary as previously described for such child or children until such child or <br />children attain the age of eighteen (18) years or marry; provided, the combined monthly payments to <br />such surviving spouse and children shall in no case exceed sixty (60) percent of the monthly base salary, <br />and in which event the thirty-five (35) percent maximum benefit for the eligible children shall be <br />prorated between them; provided, further, that if there is no surviving spouse entitled to benefits in any <br />month, the surviving spouse's benefit will be divided equally among the then eligible children, but no <br />child shall be entitled to more than fifty (50) percent of the surviving spouse's benefit; <br /> I. There shall be paid upon the death of any employee retired under Section 2.62.100 or <br />upon nonservice-connected death prior to retirement under Section 2.62.100, benefits which are seventy- <br />five (75) percent of the benefits provided by subsection H of this section except that the combined <br />children's benefit shall not exceed thirty-one and one-fourth (31.25) percent of the monthly base salary; <br />provided, however, that upon the death of any employee who is eligible for retirement but who has not <br />yet retired, the benefits shall be the same as are provided in subsection H of this section and the <br />percentage limitations herein set forth shall not apply; <br /> J. There shall be paid upon the death of any employee retired under Section 2.62.080(B) or <br />(C) a monthly benefit which bears the same ratio to the benefits provided in subsection H of this section <br />as the monthly benefit received by the employee bears to one-half of the base monthly salary in effect at <br />date of retirement; <br /> K.
