(o ~O I AN ORDINANCE VACATING AND SURRENDERING A PUBLIC WALKWAY RIGHT-OF-WAY FROM CHAMBERLAIN AVENUE TO BARTMER AVENUE, IMMEDIATF, LY NORTH OF 66TM STREET, BUT RESERVING PUBLIC UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. WHEREAS, there is right-of-way for a public walkway from Chamberlain Avenue to Bartmer Avenue, immediately north of 66th Street, in West Chamberlain Park Subdivision in University City, in St. Louis County, Missouri; and WHEREAS, due notice of a public hearing to be held by the City Council in the City Council Chambers at City Hall on April 12, 1999 at 7:30 p.m., to hear any comments concerning the proposed vacation of said right-of-way, was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on March 19, 1999; and WHEREAS, said public heating was held at the time and place specified in said notice, and all comments concerning said vacation were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY. MISSOURI, AS FOLLOWS: Section 1. The right-of-way for a public walkway from Chamberlain Avenue to Bartmer Avenue, immediately north of 66th Street in University City, in St. Louis County, Missouri, and all of University City's right, title and interest therein is hereby vacated, surrendered and quitclaimed, reserving, however, all public utility easements, if any; said property is more specifically described as follows: The walkway is on two parcels of land between Bartmer Avenue and Chamberlain Avenue, immediately north of 66th Street, and is in West Chamberlain Park Subdivision, a subdivision of Lot 2 of the Sutter Estate, in University City, and St. Louis County, Missouri. It is recorded in Book 7 Page 18, and was filed for record on November 7, 1904, in the records of the St. Louis County Recorder of Deeds. The two parcels are more particularly described as follows: The northern parcel is 10 feet wide and 142 feet long, and extends from the south right-of- way line of Bartmer Avenue, 60 feet wide, southwardly to the north right-of-way line of an alley 15 feet wide. The parcel is bounded on the east side by the west line of lot 81 of the above subdivision, and is bounded on the west side by the east line of lot 82 of the above subdivision. The parcel contains an area of approximately 0.033 acres. All existing utility easements within the parcel shall remain in effect.
