BILL NO. 'f~ <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE AMENDING CHAPTERS 9.08 AND 9.16 OF THE <br />UNIVERSITY CITY MUNICIPAL CODE, RELATING TO OFFENSES AGAINST <br />PUBLIC PEACE AND DECENCY, AND PROPERTY OFFENSES, <br />RESPECTIVELY, BY ENACTING THEREIN NEW SECTIONS TO BE KNOWN <br />AS "SECTION 9.08.250 HATE CRIMES," "SECTION 9.16.130 INSTITUTIONAL <br />VANDALISM," AND "SECTION 9.16.140 TAMPERING WITH PROPERTY IN <br />THE SECOND DEGREE;" CONTAINING A SAVING CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 9.08 and 9.16 of the University City Municipal Code, relating to <br />offenses against public peace and decency, and property offenses, respectively, are hereby amended <br />by enacting therein new sections to be known as "Section 9.08.250 Hate crimes," "Section 9.16.130 <br />Institutional Vandalism," and "Section 9.16.140 Tampering with property in the second degree," <br />which shall read as follows: <br /> <br />9.08.250 Hate crimes. <br /> <br />Definitions. For purposes of this section, the following terms mean: <br />1. "Disability," a physical or mental impairment which substantially limits one <br /> or more of a person's major life activities, being regarded as having such an <br /> impairment, or a record of having such an impairment; and <br />2. "Sexual orientation," a male or female heterosexuality, homosexuality or <br /> bisexuality by inclination, practice, identity or expression, or having a self- <br /> image or identity not traditionally associated with one's gender. <br /> <br />For all violations of the following, which the city believes to be knowingly motivated <br />because of race, color, religion, national origin, ancestry, age, sex, sexual orientation, <br />disability, handicap or health-related condition of the victim or victims, the city may <br />charge the violation under this section: <br /> <br />1. Section 9.08.020, <br />2. Section 9.08.040, <br />3. Section 9.08.050, <br />4. Section 9.08.060, <br />5. Section 9.08.210, <br />6. <br />7. <br /> <br />, <br /> <br />relating to assault in the third degree; <br />relating to disturbing the peace; <br />relating to unlawful assembly; <br />relating to rioting; <br />relating to harassment; <br /> <br />Section 9.08.220, relating to stalking; <br />Subdivision 1 of subsection A of Section 9.16.030, relating to property <br />damage; <br />Section 9.16.040, relating to trespass in the first degree; <br /> <br /> <br />
