service drops of 125 feet or less unless the Franchise demonstrates to the <br />City Council's satisfaction, evidenced by written derision, that circumstances <br />justify a specific charge. Where a drop exceeds 125 feet in length, a <br />Franchisee may charge the Subscriber for the difference between <br />Franchisee's actual costs associated with installing a 125-foot drop, and the <br />Franchisee's actual cost of installing the longer drop, provided that drop <br />length shall be the shorter of (1) the actual length of installed drop or (2) the <br />shortest practicable distance to the point where the Franchisee would be <br />required to extend its distribution System. <br /> <br />3. Location of Drops. Except as federal rate regulations may other <br />wise require, in any area where a Franchisee would be entitled to install a <br />drop above ground, the Franchisee will provide the Subscriber the option to <br />have the drop installed underground, but may charge the Subscriber the <br />difference between the actual cost of the above-ground installation and the <br />actual cost of the underground installation. <br /> <br />4. Time for Extension. A Franchisee must extend service to any <br />Person who requests it (1) within seven days of the request within the <br />Franchise Area or where service can be provided by activating or installing <br />a drop within 125 feet of the existing distribution system. <br /> <br />5. Because existing conditions can vary dramatically, commercial <br />customers must pay all reasonable costs (including time and materials) of <br />connection at the election of Franchisee. <br /> <br />System Tests and Inspections. <br /> <br />1. Tests. A Franchise shall perform the following tests to demonstrate <br />compliance with the requirements of the Franchise and other performance <br />standards established by federal law. All tests shall be conducted in <br />accordance with federal rules and in accordance with the most recent edition <br />of NCTA's "Recommended Practices for Measurements on Cable Television <br />Systems," or if no recent edition exists, such other appropriate manual as the <br />parties may designate. <br /> <br />a. Preconstruction quality control on cable and equipment. <br /> <br />A Franchisee shall perform precenstruction quality tests on <br />System components. In case of passive components, this will <br />include testing a significant sample of devices to verify <br />compliance with manufacturer's specifications. <br /> <br />33 <br /> <br /> <br />
