protect any and all existing structures and facilities belonging to the City and <br />any other Person. All work performed by the Franchisee pursuant to this <br />section shall be done in such reasonable manner prescribed by the City or <br />other officials having jurisdiction thereover. <br /> <br />H. Interference with Public Projects. <br /> <br /> Nothing in this Ordinance shall be in preference or hindrance to the right of the City <br />and any board, authority, commission or public service corporation to perform or carry on <br />any public works or public improvements of any description. <br /> <br />I. Publicizing Proposed Construction Work. <br /> <br /> Unless not possible due to emergency circumstances, Franchisee shall publicize <br />proposed construction work at least ten (10) days prior to commencement of that work by <br />causing written notice of such construction work to be delivered to the City Clerk and by <br />notifying those Persons most likely to be affected by the work in at least two (2) of the <br />following ways: by telephone, in person, by mail, by distribution of fiyers, by publication in <br />local newspapers, or in any other manner reasonably calculated to provide adequate <br />notice. In addition, unless not possible due to emergency circumstances, before entering <br />onto any Person's property, a Franchisee shall contact the property owner or occupant at <br />least one (1) day in advance. If a Franchisee must enter a private building, it must have <br />permission of the owner or occupant. <br /> <br />J. System Maintenance. <br /> <br />1. Interruptions to be Minimized. A Franchisee shall schedule <br />maintenance so that activities likely to result in an interruption of service are <br />performed during periods of minimum Subscriber use of the system. <br /> <br />2. Maintenance Practices. In addition to its other obligations, a <br />Franchisee shall (A) use replacement components of good and durable <br />quality, with characteristics better or equal to replaced equipment; and (B) <br />follow the more stringent of maintenance standards specified in the <br />Franchise Agreement, cable televisions industry maintenance standards of <br />Franchisee's maintenance standards. <br /> <br />K. Continuity of Service. <br /> <br />1. It shall be the right of all Persons in a Franchisee's Franchise Area to <br />receive all available services from the franchisee as long as their financial <br />and other obligations to the Franchisee are satisfied, and subject to <br /> <br />37 <br /> <br /> <br />
