Upon notice fi.om the director of public works that the excavation work is being <br />prosecuted contrary to the permit or in an unworkmanlike or unsafe manner, such <br />work shall immediately stop. The stop work order shall be in writing and shall be <br />given to the person doing the work or posted at the work site. <br /> <br />The director of public works is authorized to adopt and promulgate .roles and <br />regulations to interpret and implement the provisions of this section to secure the <br />intent thereof and to promote the public health, safety and general welfare. <br /> <br />Section 12.04.170 Street use permit - Bond; deposit. <br /> <br />No person shall construct, alter or repair a building or cause the same to be done, or <br />help, aid or assist another person construct, alter or repair a building, before a written <br />permit to do such work is issued by the director of public works afler application <br />therefor is made. The applicant shall pay a filing fee in the amount of fifty dollars <br />($50.00) to the director of public works. The amount of the filing fee may be <br />adjusted by the director of public works from time to time to reflect the average cost <br />of the actual time expended in the administration, inspection and superintendence of <br />such work. <br /> <br />Before such permit is issued, the applicant shall deposit with the.director of public <br />works a continuing bond with good and sufficient sureties payable to the city, both <br />conditional upon the removal of all building materials or debris deposited on the <br />street, alley, sidewalk, tree lawn, highway or other public place as a result of the <br />construction, alteration or repair of the building, and the restoration of the street, <br />alley, sidewalk, tree lawn, highway or other public place in as good a condition as it <br />was before the building work was done. The amount of the deposit and bond shall <br />be sufficient, in the judgment of the director of public works, to ensure the faithful <br />performance of such conditions, and in no case shall the deposit be less than two <br />hundred fifty dollars ($250.00) and the bond less than three thousand dollars <br />($3,000.00). All cash so deposited shall be kept in a special fund in the city <br />depository and shall be repaid after all deductions, if any, have been made by the <br />director of public works to satisfy such conditions and as provided in Section <br />12.04.180. Upon completion of the removal and restoration work and any other work <br />as provided in Section 12.04.180, to the satisfaction of the director of public works, <br />the director of public works shall authorize the termination of the bond. <br /> <br />Upon notice fi.om the director of public works that the removal or restoration work <br />is being prosecuted contrary to the permit or in an unworkmanlike or unsafe manner, <br />such work shall immediately stop.
