BILL NO. %~t']f'l <br /> <br />ORDINANCE NO. ~35 I~) <br /> <br />AN ORDINANCE ESTABLISHING A SIX (6) MONTH MORATORIUM <br />DURING WHICH SEXUALLY ORIENTED BUSINESSES SHALL NOT BE <br />APPROVED OR ANY PERMIT AUTHORIZING ANY SUCH USE GRANTED; <br />CONTAINING A SAVINGS CLAUSE, PROVIDING A PENALTY, AND <br />CONTAINING AN EMERGENCY CLAUSE. <br /> <br /> WHEREAS, the City of University City has undertaken a study of the issues related to <br />"adult" or sexually oriented businesses and said study has not yet been completed; and <br /> <br /> WHEREAS, such uses may have a significant effect within the City and it is essential to <br />complete such study in order to determine their impact in terms of their secondary effects and to <br />develop content-neutral regulations directed to any adverse secondary effects of such uses; and <br /> <br /> WHEREAS, the City of University previously adopted a six (6) month moratorium which <br />was adopted on June 25, 2001 and expired on December 26, 2001 and a reasonable extension of <br />the period of time will allow for the completion of such study; and <br /> <br /> WHEREAS, the City Plan Commission, in a meeting at City Hall on December 12, 2001, <br />considered such matters and has recommended to the City Council that an extension of the <br />moratorium of six (6) months be established, during which sexually oriented businesses, including <br />adult book stores, adult novelty stores, adult video stores, adult places of entertainment and other <br />sexually oriented businesses shall not be approved or any permit authorizing such use granted, so <br />as to permit such study to be completed; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City Council in the City <br />Council Chambers at City Hall at 7:30 p.m., January 7, 2002, was duly published in the St. Louis <br />Countian, a newspaper of general circulation within said City on December 21, 2001; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in said notice, and <br />all suggestions or objections concerning said moratorium were duly heard and considered by the <br />City Council. <br /> <br /> NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. There is hereby established a moratorium taking effect retroactively and shall <br />be in force from and after its passage as provided by law from the date of the previous moratorium's <br />expiration date of December 26, 2001 until six (6) months thereafter during which sexually oriented <br /> <br />K:\WPOFFICE\WPDATA\x-adult business.ord2.wpd <br /> <br /> <br />
