BILL NO. ORDINANCE NO. 63'71 AN ORDINANCE AMENDING CHAPTER 2.64 OF THE UNIVERSITY CITY MUNICIPAL CODE, RELATING TO THE NONUNIFORMED EMPLOYEES RETIREMENT SYSTEM, BY REPEALING SECTION 2.64.070 THEREOF, RELATING TO CREDITABLE SERVICE, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 2.64.070 CREDITABLE SERVICE," THEREBY AMENDING SAID SECTION SO AS TO PROVIDE A METHOD FOR DETERMINING THE CITY MANAGER'S CREDITABLE SERVICE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 2.64 of the University City Municipal Code, relating to the non- uniformed employees retirement system, is hereby amended by repealing Section 2.64.070 thereof, relating to creditable service, and enacting in lieu thereof a new section to be known as "Section 2.64.070 Creditable service;" so that said section, as so amended, shall read as follows: 2.64.070 Creditable service. The years of creditable service of a member other than the city manager shall be the number of years and completed months of service during which the member received compensation prior to the operative date plus the number of years and completed months of service during which the member received compensation after the operative date from the beginning of his or her employment with the city until his or her employment is terminated, subject to the provisions set forth in subsections B through G of this section. The years of creditable service of the city manager shall be the number of years and completed months of service during which the city manager received compensation after June 30, 2001 until his or her employment is terminated, plus the number of years and months of service necessary for the city manager to have a total of 13 (thirteen) years of creditable service so as to be entitled to pension benefits pursuant to section 2.64.140, subject to the provisions of subsections B through G of this section. No creditable service for prior employment shall be granted an employee who becomes a member after July 1, 1966, unless the member was employed on July 1, 1966. If a member resumes employment within one year after the member's employment is terminated and provided the member has not withdrawn his or her accumulated contributions, the member's creditable service as of the date of termination shall be restored. Creditable service to date of absence shall not be forfeited by reason of any absence without pay due to leave granted by the city because of illness, military service or, for a period not in excess of one year, for any other reason, provided the employee returns to active service prior to the expiration of his or her leave.
