(2) The City reserves the right to reduce or discontinue C.A.L.O.P. funding <br />being provided by Franchisee. The City must provide the Franchisee with at least 90 days <br />notice of any changes. <br /> <br /> (3) City agrees not to request any increase in C.A.L.O.P. funding for a <br />period of three (3) years. In the event that the City requests an increase in C.A.L.O.P. <br />funding, the increase shall be limited to adjustments for inflation annually on the <br />anniversary date of the Franchise Agreement pursuant to the most recent Consumer Price <br />Index figures then available. <br /> <br /> (4) In the event that the City makes changes to the C.A.L.O.P. fundi.ng, <br />the Franchisee reserves the right to exercise a billing message that notifies subscribers of <br />the future change. For administrative purposes, the Franchisee reserves the right to delay <br />the City's request for C.A.L.O.P. changes up to forty-five (45) days while Franchisee <br />notifies subscribers of the future billing changes. <br /> <br />.................. The Franchisee reserves the right to recover production cost at a <br /> rate of $25 per hour for City production request. The Franchisee will provide advice and <br /> technical assistance to the City to expand and better utilize governmental access. <br /> <br /> (h) Additional Equipment and Services: <br /> Franchisee will install internet access (functioning with high speed cable <br />modem or lesser technology as requested) at City Hall and at each consenting public <br />library and public and private elementary and secondary school within the Franchise Area <br />at no charge. Franchisee will provide City Hall and each consenting public library and <br />public and private elementary and secondary school with one internet account with <br />Franchisee's affiliated internet service at no charge. Franchisee will provide initial training <br />in conjunction with such additional equipment and services at no charge. <br /> <br /> (i) Costs and Payments Not Franchise Fees: <br /> The parties for purposes of this Agreement agree, except as otherwise <br />provided herein, that any costs to the Franchisee associated with the provision of support <br />for public, educational or governmental access pursuant to this Franchise Agreement do <br />not constitute and are not part of a franchise fee, and fall within one or more of the <br />exceptions to 47 U.S.C.
