(2) Franchise Renewal: <br /> <br /> Application by the Franchisee for renewal of its Franchise under this <br />Agreement shall be made as provided in Section 4 of the Cable Ordinance, in a manner <br />consistent with Section 626 of the Cable Act, 47 U.S.C. § 546, as amended. <br /> <br />(3) Franchise Modification Based on New Technology: <br /> <br /> It shall be the policy of the City to modify this Franchise, pursuant to <br />Section 4 of the Cable Ordinance, in good faith upon application by the Franchisee when <br />necessary to enable the Franchisee to take advantage of technological developments in <br />the transmission of video, audio, digital and data signals which will afford the Franchisee <br />the opportunity to more effectively, efficiently and/or economically serve its Subscribers. <br /> <br />(4) Operating Reports: <br /> <br /> In lieu of filing with the City acceptance test results, continuing test <br />results, copies of agency filings, copies of opinion surveys, and copies of as-built <br />construction maps pursuant to Sections 5(f)(1)(b), 5(f)(1)(c), 7(o)(1), 7(c)(2) and 7(0)(3)(a), <br />respectively, of the Cable Ordinance, the Franchisee shall maintain such records and make <br />them available to the City for inspection and copying on request, and the Franchisee shall <br />also file a written report with the City Clerk not later than 120 days after the end of each <br />fiscal year a report which shall include the following: <br /> <br /> (i) A summary of the previous year's activities in development of <br />the Cable System, including but not limited to descriptions of programming services <br />begun or dropped, the number of Subscribers gained or lost for the year, the <br />number of pay units sold, and the character and extent of the services rendered to <br />such Users of the System; <br /> <br /> (ii) A summary of service calls, including the number and nature of <br />the calls received and an explanation of the causes and dispositions of such calls; <br /> <br /> (iii) A report showing the number of outages on a monthly basis for <br />the prior year, and identifying the average time of an outage per month, the average <br />number of subscribers effected by the monthly outages, and the cause of each <br />outage per month; <br /> <br />18 <br /> <br /> <br />
