(iv) An ownership report, indicating all Persons who at any time <br />during the preceding year did control or benefit from an interest in the Franchise of <br />thirty percent (30%) or more; <br /> <br /> (v) A summary report on the System's technical tests and <br />measurements; and <br /> <br />(vi) A list of key employees of the Franchisee. <br /> <br />(5) Construction Provisions (System Upgrade): <br /> <br /> Notwithstanding the requirements of Sections 5(b) and 5(f) of the <br />Cable Ordinance, the City acknowledges that, pursuant to Section 624(e) of the Cable Act, <br />47 U.S.C. §544(e), it may not prohibit, condition, or restrict the Franchisee's use of any <br />type of Subscriber equipment or any transmission technology in order for the Franchisee to <br />meet its upgrade commitments. <br /> <br />(6) Technical Standards: <br /> <br /> Notwithstanding the requirements of Sections 5 and 6 of the Cable <br />Ordinance, the Franchisee shall be responsible for insuring that the Cable System is <br />designed, installed and operated in a manner that fully complies with FCC rules in Subpart <br />K of Part 76 of Chapter I of Title 47 of the Code of Federal Regulations, as revised or <br />amended from time to time. As provided in these rules, the City, upon request, shall have <br />the right to obtain a copy of tests and records required in accordance with such rules, and <br />shall retain its authority, if any, to enforce compliance with standards as allowed by federal <br />law. <br /> (7) In lieu of Section VI (I) of the Cable Ordinance, Franchisee shall <br />maintain a business office within St. Louis County to address customer service issues. <br /> <br /> (8) £mergencyAlert System: In accordance with and at the time required <br />by the provisions of FCC Regulations, Part II, Subpart D, Section 11.51, and as such <br />provisions may be amended from time to time, the Franchisee shall install and maintain an <br />emergency alert system for use in transmitting emergency act notifications and emergency <br />act terminations in local and state-wide situations as may be designated to be an <br />emergency by the local primary, state primary and/or the state emergency operations <br />center, as those authorities are defined in FCC Regulation Section 11.1 8. The Franchisee <br />shall also comply with 47 U.S.C. §544(g) and regulations promulgated pursuant thereto as <br />provided in Section 6(h) of the Cable Ordinance. <br /> <br />19 <br /> <br /> <br />
