August 2, 2002 Text Amendment Ordinance Page 17 of 21 <br /> <br />34-77.1 Building Permit Required <br /> <br />It shall be unlawful to enlarge, alter or repair any historic landmark or to <br />construct, enlarge, alter or repair any building, structure, humanly <br />constructed object or environmental feature within an historic district <br />when such activities are regulated by the University City Zoning Code <br />and Ordinance establishing a specific historic landmark or district <br />without first obtaining a building permit, except as specifically exempted <br />by the regulations for specific historic landmarks or districts. <br /> <br />o <br /> <br />It shall be unlawful to construct a new building or structure in an historic <br />district or on a lot occupied by an historic landmark without first <br />obtaining a building permit. <br /> <br />34-77.2 Referral to Historic Preservation Commission <br /> <br />1. Zoning Administrator Review: <br /> <br />In examining an application for a building permit to which Section 34- <br />77.1 applies, the Zoning Administrator shall determine if the <br />enlargement, alteration, repair and/or construction is deemed to require <br />commission review in the regulations and standards contained in the <br />ordinance creating the specific historic landmark or historic district. The <br />Zoning Administrator may, when the ordinance does not require referral, <br />immediately approve issuance of a building permit but shall thereupon <br />notify the commission of such action. With regard to all other <br />applications for a building permit, the Zoning Administrator shall <br />forward a copy of the application to the Historic Preservation <br />Commission for interpretation, advice and recommendations. All <br />applications for building permits pertaining to publicly owned historic <br />landmark structures or publicly owned structures within an historic <br />district shall be referred to the Commission for interpretation, advice and <br />recommendations.
