August 2, 2002 Text Amendment Ordinance Page 16 of 21 <br />application to the Historic Preservation Commission. If, within fifteen <br />(15) days of the receipt of the application to demolish, the Historic <br />Preservation Commission has not responded, the application shall be <br />deemed approved by the Historic Preservation Commission. <br /> <br />SECTION 34-75 CONDITIONAL USES FOR AN HISTORIC LANDMARK <br />OR WITHIN AN HISTORIC DISTRICT <br /> <br />The Zoning Administrator shall forward a copy of any application for a <br />Conditional Use permit for an historic landmark or within an historic district or <br />within 300 feet of an historic district or properties on the National Historic <br />Register to the Historic Preservation Commission. The Commission shall <br />review such applications and may appear at the public hearing held by the Plan <br />Commission in order to present the Commission's findings of fact and <br />conclusions as to whether or not the proposed Conditional Use meets the review <br />criteria for Conditional Use permit approval specified in Article 11, Sections 34- <br />132.1 of this Chapter and the ordinance establishing the specific historic <br />landmark or district. <br /> <br />SECTION 34-76 VARIANCE TO AN HISTORIC LANDMARK OR WITHIN <br />AN HISTORIC DISTRICT <br /> <br />The Zoning Administrator shall forward a copy of any application for the <br />granting of a variance in connection with an historic landmark or within an <br />historic district or within 300 feet of an historic district or properties on the <br />National Historic Register to the Historic Preservation Commission. The <br />Commission shall review such applications and may appear at the public <br />meeting held by the Board of Adjustment in order to present the Commission's <br />findings of fact and conclusions as to whether or not the proposed variance <br />meets the review considerations and standards for granting a variance specified <br />in Article 12, Sections 34-142.3 and 34-142.4 of this Chapter and the ordinance <br />establishing the specific historic landmark or district. <br /> <br />SECTION 34-77 BUILDING PERMITS FOR AN HISTORIC LANDMARK <br />OR WITHIN AN HISTORIC DISTRICT OR WITHIN 300 FEET OF AN <br />HISTORIC DISTRICT OR PROPERTIES ON THE NATIONAL HISTORIC <br />REGISTER <br /> <br />x-textamord08-02-02K:\WPOFFICE\Wpdata\x-textamord08-02-02.frm <br /> <br /> <br />
