August 2, 2002 Text Amendment Ordinance Page 15 of 21 <br />[insert appropriate number for that section] For all new developments, houses or <br />other major construction, a site plan showing all existing city trees located at or <br />near the property shall be submitted along with a statement by the owner of the <br />property verifying that no city trees shall be destroyed or damaged during <br />construction and if such destruction or damage does occur, the city shall be <br />reimbursed for the fair market price of the tree. <br /> <br />SECTION 34-120 DEVELOPMENTS SUBJECT TO SITE PLAN REVIEW <br /> <br />The requirements of this Article shall apply to all developments occurring after <br />the effective date of this Chapter, except for the following: ... <br /> <br />Additions to non-residential buildings, or new accessory non-residential <br />buildings, when the addition or new accessory building is less than <br />twenty-five (25) percent of the existing principal building; the addition or <br />new accessory building does not exceed 1,000 square feet in gross floor <br />area (unless the structure is greater than 10 feet higher than the principal <br />structure or unless the structure could be considered a tower of any <br />type); no new curb cuts are required; and when such new construction <br />does not reduce existing parking or significantly modify existing on-site <br />circulation as determined by the Zoning Administrator. <br /> <br />SECTION 34-78 PERMIT TO DEMOLISH <br />34-78.1 Permit Required <br />It shall be unlawful to demolish any building, structure or humanly constructed <br />object anywhere in University City without first obtaining the appropriate permit <br />in accordance with the requirements of the building code and complying with <br />the procedures set forth in this section. Demolition shall be construed to include <br />an act or process which destroys, in part or in whole a structure or which <br />threatens to destroy a structure by failure to maintain it in a condition of good <br />repair and maintenance. Nothing in this article shall be construed so as to <br />prohibit the Building Commissioner from acting under any emergency <br />provisions of Chapter 6 of the Municipal Code of University City. <br /> <br />34-78.2 Review Procedures <br />1.
