streets, alley ways and pavement located within the areas included within the grant of <br />permanent and temporary construction easements, to issue permits in connection with <br />such construction and reconstruction work and to inspect and approve such <br />construction and reconstruction work. In addition, Bi-State agrees to construct all Cross <br />County Metrolink Extension (Segment I) improvements and appurtenant facilities <br />located within the areas included within the permanent easements and temporary <br />construction easements granted hereunder in substantial conformity with the Facilities 2 <br />and Station Finishes contracts as those respective documents are reviewed and <br />approved by the City of University City, Missouri. All easements must be returned to <br />equivalent or better condition. <br /> <br /> Section V. The City of University City, Missouri, utilities and governmental <br />service entities shall have the right and access to go upon the rights-of-way that are the <br />subject of the easements granted herein by this Ordinance for purposes associated with <br />the maintenance, construction or planning of future facilities and/or improvements that <br />are or may be located within said easement areas, so long as such access and <br />purposes are carried out without disruption or disturbance to the construction, <br />establishment, operation and maintenance of the Cross County MetroLink Segment I <br />Extension. The City of University City, Missouri and all such utilities and governmental <br />service entities shall follow Bi-State standard operating protocol (i.e., Policy & <br />Procedure for Work Performed on MetroLink R.O.W.), a copy of which has been <br />provided to University City, when accessing areas on or adjacent to Bi-State MetroLink <br />facilities and shall give Bi-State reasonable notice of the need to access said easement <br />areas in accordance with said standard operating procedure protocol (except in the <br />case of emergency), and will cooperate with Bi-State to ensure that there is no <br />unreasonable disruption in the construction, establishment, operation and maintenance <br />of the Cross County MetroLink Segment I Extension. <br /> <br /> Section VI. The City of University City, Missouri, the City Manager, the City <br />Council and other appropriate officers, agents and employees of the City of University <br />City, Missouri are hereby authorized and directed to take such further actions and <br />execute such other documents, certificates and instruments as may be necessary or <br />desirable to carry out and comply with the intent of this Ordinance. <br /> <br /> Section VII. This Ordinance shall be in full force and effect after its passage <br />and approval as provided by law. <br /> <br />Passed this 24th day of March, 2003. <br /> <br /> 5 <br /> <br /> <br />
