Extension, the City of University City, Missouri, to the extent of its interest, hereby <br />grants and conveys to Bi-State temporary construction easements under, over or across <br />the following public rights-of-way and green space properties located within and owned <br />by the City of University City, Missouri: <br /> <br />that portion of the property commonly known as the Ackert Walk <br />Way, full width of said Ackert Walkway and extending north from a <br />line approximately thirty (30) feet north of and parallel to the north <br />line of the Forest Park Parkway north approximately three hundred <br />twenty (320) feet as generally shown on the aerial photograph <br />attached hereto as Exhibit E~ and incorporated herein by this <br />reference. <br /> <br />that portion of the pedestrian underpass currently existing under <br />Pershing Avenue and the Forest Park Parkway generally located <br />along a southward extension of Wellesley Avenue as generally <br />shown on the aerial photograph attached hereto as Exhibit B and <br />incorporated herein by this reference. <br /> <br /> It is understood that the aforementioned temporary construction <br />easements granted in this Section II are granted and conveyed by the City of University <br />City, Missouri to Bi-State for the activities related to the construction, establishment, <br />operation and maintenance of the Cross County MetroLink Segment I Extension. <br /> <br /> The temporary construction easements granted in this Section II shall <br />commence on the effective date of this ordinance and shall terminate when construction <br />of the Cross County MetroLink Segment I Extension and its appurtenant facilities are <br />completed and said extension has opened for revenue service. <br /> <br /> Section III. In furtherance of and for the purpose of providing for the ownership <br />and future maintenance of the pedestrian overpass commonly known as the Ackert <br />Walkway, that will be constructed within the city limits of the City of University City, <br />Missouri, the City of University City, Missouri hereby grants and conveys to St. Louis <br />County, Missouri, as the owner of said overpass (or such other entity or entities that <br />may be deemed appropriate to accomplish such purposes), a permanent easement <br />over that portion of the Ackert Walkway on which said overpass will be constructed by <br />Bi-State as part of the Cross County MetroLink Segment I Extension project, said <br />permanent easement to include future maintenance of said overpass by St. Louis <br />County (or such other entity or entities that may be deemed appropriate to accomplish <br />such purposes). The area of said permanent easement is generally described as that <br />portion of the property commonly known as the Ackert Walkway, full width of said Ackert <br />Walkway, and extending from the north line of the Forest Park Parkway north <br />approximately three hundred fifty (350) feet as shown on the aerial photograph attached <br />hereto as Exhibit C and incorporated herein by this reference. <br /> <br /> Section IV. The City of University City, Missouri reserves the right to review <br />and approve all plans regarding the construction and reconstruction of sidewalks, <br /> 4 <br /> <br /> <br />
