BILL NO. <br /> <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION OF A <br />PROPOSITION AUTHORIZING THE CITY OF UNIVERSITY CITY, <br />MISSOURI TO LEVY AND IMPOSE ANNUALLY FOR THE <br />REPAIR OF LATERAL SEWER LINES ON OR CONNECTING <br />RESIDENTIAL PROPERTY HAVING SIX OR LESS DWELLING <br />UNITS A FEE NOT TO EXCEED FIFTY DOLLARS PER YEAR, TO <br />THE QUALIFiED VOTERS OF THE CITY AT A SPECIAL <br />ELECTION TO BE HELD ON FEBRUARY 3, 2004. <br /> <br /> WHEREAS, the City of University City, Missouri (the "City"), is within the <br />boundaries of a sewer district established pursuant to Article VI, Section 30(a) of the <br />Missouri Constitution; and <br /> <br /> WHEREAS, on August 16, 1999, the City Council passed Ordinance No. 6212, <br />which levied and imposed an annual fee of twenty-eight dollars upon all real property <br />subject to taxation in the City, for the repair of lateral sewer lines on residential property <br />having six or less dwelling units; and <br /> <br /> WHEREAS, said fee was approved and passed by a majority of the qualified <br />voters of the City at an election held on April 6, 1999; and <br /> <br /> WHEREAS, at the time said fee was approved and passed, it was the maximum <br />amount permitted under Section 249.422 RSMo; and <br /> <br /> WHEREAS, at the time said fee was approved and passed, Section 249.422 <br />RSMo did not contain any provisions on how the fee should be imposed upon <br />condominium units; and <br /> <br /> WHEREAS, Section 249.422 RSMo now provides that if approved by a majority <br />of the voters voting on the proposal, the City may levy and impose annually for the repair <br />of lateral sewer service lines on or connecting residential property having six or less <br />dwelling units a fee not to exceed fifty dollars per year; and <br /> <br /> WHEREAS, Section 249.422 RSMo now contains provisions on how the fee shall <br />be imposed upon condominium units; and <br /> <br /> WHEREAS, the City desires the authority to increase the fee to an amount not to <br />exceed fifty dollars per year, to be imposed on residential property as provided under <br />Section 249.422 RSMo as amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> <br />
