b. Landscaping The Project Shall include landscaping in accordance with a landscaping plan (the "Landscaping Plan") which was previously approved by the City in connection with the City's approval of the development and building plans for the Project. 7. PARKING REGULATIONS Parking shall be provided in accordance with the Zoning Code. The Area and Adjacent Developer Property shall collectively contain not less than 226 parking spaces after completion of the Project. This requirement is in excess of the minimum number of parking spaces required by the Zoning Code. 8. SIGN REGULATIONS The Developer shall comply with all City ordinances regarding signage. 9. BUILDING, CONDITIONAL USE AND SIGN PERMITS The Developer shall obtain all necessary building, conditional use, or sign permits as required by the City. The Developer shall comply with all applicable city regulations, ordinances and codes. 10. PUBLIC IMPROVEMENTS The Project will not require the construction of any additional public improvements. 11. PRIOR APPROVALS In the event that the Developer has obtained prior approvals from the City or any of its agencies with respect to the criteria set forth in Paragraphs 1, 4, 5, 6, 7, 8 and 9 of this Section D, the terms of such prior approvals shall govern and shall be deemed to be in accordance with this Plan in all respects. E. PROPOSED SCHEDULE OF DEVELOPMENT The Project will be completed within two (2) years from the date of execution o~' a performance agreement for completion of the Project (the "Performance Agreement"). The Project shall be completed in one phase. The City may, but shall not be obligated to, alter the above schedule as economic or other conditions warrant. F. PROJECT FINANCING: SOURCE OF FUNDS All costs associated with the Project will be borne by the Developer including the City's reasonable attorneys' fees.
