' 3P160i3/1920' <br /> <br />BILL NO. ~7 $ t <br /> <br />so. t, qqq <br /> <br />AN ORDINANCE VACATING AND SURRENDERING A PORTION OF THE <br />RIGHT-OF-WAY OF HARRISON AVENUE NORTH OF LYNN AVENUE IN <br />BELLEMONT PLACE SUBDIVISION AND HAWTHORNE TERRACE <br />SUBDIVISION, BUT RESERVING ANY PUBLIC UTILITY EASEMENTS, <br />AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE <br />OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, <br />MISSOURI. <br /> <br /> WHEREAS, Harrison Avenue is a public street in Bellemont Place Subdivision and <br />Hawthorne Terrace Subdivision in University City, in St. Louis County, Missouri; and <br /> <br /> WHEREAS, due notice of a public hearing, to be held by the City Council in the City <br />Council Chambers at City Hall on July 12, 2004 at 7:30 p.m., to hear any comments concerning <br />the proposed vacation of a portion of said fight-of-way, was duly published in the St. Louis <br />Countian, a newspaper of general circulation within said City, on June 30, 2004; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in said notice, <br />and all comments concerning the vacation street right-of-way were duly heard and considered by <br />the City Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. A portion of the right-of-way of a public street known as Harrison <br />Avenue, in University City, in St. Louis County, Missouri, and all of the City of University <br />City's right, title and interest therein is hereby vacated, surrendered and quitclaimed, reserving, <br />however, all public utility easements, if any; said property is more specifically described as <br />follows: <br /> <br />PARCEL D <br /> <br />Parcel D is approximately 40' x 54.35' and is located in the right-of-way of Harrison Ave. (90 <br />feet wide). Parcel D is within the Plat of Dedication of parts of Lots 3, 4, 5, 6, 7, & 8 of <br />Bellemont Place, a subdivision recorded in book 38, page 55 in the records of the St. Louis <br />County Recorder of Deeds. Parcel D is more particularly described as follows: <br /> <br />Beginning at the northeast comer of Lot 5 of Block B of the Resubdivision of Blocks "A & B" of <br />Hawthorne Terrace, as recorded in book 35, page 76 of the records of the St. Louis County <br />Recorder of Deeds, then proceed 54.35 feet northwardly along the west right-of-way line of <br />Harrison Ave. (90 feet wide) to a point, then proceed 40 feet eastwardly along a line <br />perpendicular to the west right-of-way line of Harrison Ave. to a point, then proceed <br />southwardly 54.35 feet along a line parallel to the west right-of-way line of Harrison Ave. to a <br /> <br /> <br />
