' 3P160i3/1920' BILL NO. ~7 $ t so. t, qqq AN ORDINANCE VACATING AND SURRENDERING A PORTION OF THE RIGHT-OF-WAY OF HARRISON AVENUE NORTH OF LYNN AVENUE IN BELLEMONT PLACE SUBDIVISION AND HAWTHORNE TERRACE SUBDIVISION, BUT RESERVING ANY PUBLIC UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. WHEREAS, Harrison Avenue is a public street in Bellemont Place Subdivision and Hawthorne Terrace Subdivision in University City, in St. Louis County, Missouri; and WHEREAS, due notice of a public hearing, to be held by the City Council in the City Council Chambers at City Hall on July 12, 2004 at 7:30 p.m., to hear any comments concerning the proposed vacation of a portion of said fight-of-way, was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on June 30, 2004; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all comments concerning the vacation street right-of-way were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. A portion of the right-of-way of a public street known as Harrison Avenue, in University City, in St. Louis County, Missouri, and all of the City of University City's right, title and interest therein is hereby vacated, surrendered and quitclaimed, reserving, however, all public utility easements, if any; said property is more specifically described as follows: PARCEL D Parcel D is approximately 40' x 54.35' and is located in the right-of-way of Harrison Ave. (90 feet wide). Parcel D is within the Plat of Dedication of parts of Lots 3, 4, 5, 6, 7, & 8 of Bellemont Place, a subdivision recorded in book 38, page 55 in the records of the St. Louis County Recorder of Deeds. Parcel D is more particularly described as follows: Beginning at the northeast comer of Lot 5 of Block B of the Resubdivision of Blocks "A & B" of Hawthorne Terrace, as recorded in book 35, page 76 of the records of the St. Louis County Recorder of Deeds, then proceed 54.35 feet northwardly along the west right-of-way line of Harrison Ave. (90 feet wide) to a point, then proceed 40 feet eastwardly along a line perpendicular to the west right-of-way line of Harrison Ave. to a point, then proceed southwardly 54.35 feet along a line parallel to the west right-of-way line of Harrison Ave. to a
