BILL NO. 8737 ORDIN^NC SO. /Ogl l AN ORDINANCE LEVYING A SPECIAL ASSESSMENT OR TAX AGAINST PROPERTY IN A BENEFIT DISTRICT FO RTH E PUBLIC IMPROVEMENT OF PERSHING HEIGHTS SUBDIVISION, AND DIRECTING THE ISSUANCE OF SPECIAL TAX BILLS. WHEREAS, on February 9, 2004, the City Council adopted a resolution declaring that the final cost of the proposed improvement assessed against the real property within the proposed neighborhood improvement district and the amount of any general obligation bonds issued therefore shall not, without a new petition or election, exceed the estimated costs of such improvement by more than twenty-five percent. And that the proposed neighborhood improvement district hereby established. Preliminary plans and specifications for the proposed improvement are hereby ordered to be made; and WHEREAS, after a public hearing on March 29, 2004, all suggestions or objections concerning the proposed improvement and proposed assessments were duly heard and passed upon by the City Council; and WHEREAS, on April 19, 2004 the City Council adopted a resolution determined that the proposed improvement shall be made in accordance with the plans and specifications set out in Exhibit "a"' that financing for the cost thereof shall be obtained as provided in Section s67.453 to 67.475 RSMo; and that after construction of the improvement has been completed, the final cost of the improvement shall be completed, and the resolution or ordinance such cost shall be assesses as special assessments against the property describe in the proposed assessment roll (Exhibit "B"); and WHEREAS, the City advertised for bids to perform the work necessary under such plans and specifications, and such bids were properly received and considered; and WHEREAS, the contract for the public improvement was let to the lowest responsible bidder, and the contract was formally executed by R.V. WAGNER, INC. and the City Manager; and WHEREAS, the public improvement was made pursuant to Resolution on April 19, 2004; and WHEREAS, the total cost of the public improvement to the property owners in the benefit district is $11,208. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The City Council hereby determines and finds that the public improvement of Pershing Heights, a subdivision in University City, Missouri, has been completed, and that the final whole cost of the public improvement is more than $11,208. Section 2. A special assessment or tax in the total amount of $11,208 is hereby levied and assessed against each parcel of real property deemed to be benefited by such improvement. The private real property in the benefit district is individually known as and numbered: 1250 Pennsylvania; 1256 Pennsylvania; 1262 Pennsylvania; 1266 Pennsylvania; 6953 Raymond; and 6944 Roberts.
