f. Common Open Space Requirements. Common open space for "PD-R" <br />developments shall be provided in accordance with the provisions of Article 5, <br />"Supplementary Regulations," Section 34-57.4. <br /> <br />g. Perimeter Buffer Requirements. <br /> <br />(1) Where a "PD-R" development proposes residential development along the <br />perimeter of the site, which is higher in density than that of an adjacent residentially <br />zoned property, there shall be a minimum thirty (30) foot wide buffer area. The <br />buffer area shall be kept free of buildings or structures and shall be landscaped or <br />protected by natural features so that all higher-density residential buildings are <br />effectively screened from the abutting lower density residential property. <br /> <br />(2) Where a "PD-R" development abuts a commercial or industrial use or district, <br />there shall be a minimum thirty (30) foot wide buffer area. This buffer area shall be <br />permanent and landscaped and/or otherwise provided with screening (i.e.; sight proof <br />fencing) so as to effectively screen the commercial or industrial use from the "PD-R" <br />development. <br /> <br />(Section 34.57.4 Common open space requirements for residential <br />developments.) <br /> <br />b. The area of each parcel of open space shall not be less than three thousand (3000) <br />square feet in area nor less than thirty (30) feet in its smallest dimension, these <br />standards may be decreased in the "HR"-high density residential district, "HRO"-high <br />density residential/office district, or the "PD" - planned development district under <br />conditional use permit review per Article 11 of the zoning code. <br /> <br /> Section 2. This ordinance shall not be construed to so as to releive any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Section 34-40.7(3) and Section <br />34-57,4(b), nor bar the prosecution for any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provisions of this <br />ordinance, shall upon conviction thereof, be subject to the penalty provided in Title 1 Chapter <br /> <br />K: I WPOFFICEI WPDA TA bc-34-40-07 & 34-57-4. textamord.fbh, wpd <br /> <br /> <br />
