<br />trustees shall have such right. This section applies to any alley or roadway accessible <br />to the public for vehicular traffic, including, but not limited to, private alleys, streets <br />or access lanes, as well as public alleys, streets and highways. <br /> <br />(SECTION 108 BOARD OF APPEALS) <br /> <br />108.1 General: In order to hear and decide appeals of orders, decisions or <br />determinations made by the ftre code official relative to the application and <br />interpretation of this code, there shall be and is hereby created a Board of Appeals. <br /> <br />108.2 Application for appeal: Any person directly affected by an order decision or <br />determination of the ftre code official shall have the right to appeal to the Board of <br />Appeals. An application for appeal shall be based on a claim that the true intent of <br />this code or the rules legally adopted thereunder have been incorrectly interpreted, <br />the provisions of this code do not fully apply, or an equivalent form of construction <br />can be used. <br /> <br />108.3 Filing procedures: All appeals shall be f1led in writing with the ftre code <br />official within thirty (30) days after the order, decision or determination is rendered <br />by the ftre code official and shall state the grounds therefore. Appeals must be <br />accompanied by a fee in the amount specifted in Section 2.66.40 the University City <br />Municipal Code. <br /> <br />108.4 Membership of board: The Board of Appeals shall consist of seven members <br />appointed by the City Council. Board members shall be appointed for ftve year terms <br />and serve until a successor has been appointed. <br /> <br />108.5 Qualifications of board members: At least three of the members shall each <br />have at least ten (10) years experience as a registered architect, builder, superintendent <br />of building construction or as a registered professional engineer with structural, civil <br />or architectural engineering experience. <br /> <br />108.6 Chairperson: The Board of Appeals shall annually select one of its members <br />to serve as chairperson. <br /> <br />108.7 Notice of meeting: The meeting shall be upon notice from the chairperson, <br />within thirty (30) days of the filing of an appeal, or at stated periodic meetings. <br /> <br />108.8 Board powers: The Board of Appeals may reverse, afftrm or modify the <br />order, decision or determination of the ftre code official. <br /> <br />108.9 Board decisions: The Board of Appeals shall act by majority vote, and a <br />quorum shall consist of at least ftve members.
