<br />C. Retailers: <br /> <br />1. The applicant for any license under subsection (C)(l), (2), (3) or (5) of this section, except <br />when applying for a renewal of any license, shall pay a filing fee of ten dollars ($10.00) <br />therefor to the director of finance. No license shall be issued for the sale of all kinds of <br />intoxicating liquor in the original package, not to be consumed upon the premises where <br />sold, except to a person engaged in, and to be used in connection with, the operation of a <br />grocery store, a drugstore or a cigar and tobacco store; however, the total number of cigar <br />and tobacco store licenses in force shall not exceed two (2). The gross receipts of retail <br />sales of groceries or drugs, or other associated products, shall exceed the gross receipts of <br />liquor sales each year preceding license renewals; except that any existing retail outlet for <br />intoxicating liquor in the original package, which has been in existence prior to the <br />enactment of this ordinance codified in this chapter and also in the event ofa sale of such <br />business, shall be eligible for renewal of its license at its present site, if it keeps a stock of <br />goods having a value according to invoices of at least one thousand dollars ($1,000.00), <br />exclusive of fixtures and intoxicating liquors. Under such license, no intoxicating liquor <br />shall be consumed on the premises where sold nor shall any original package be opened on <br />the premises of the vendor except as otherwise provided in this law. For every license for <br />sale at retail in the original package, the licensee shall pay to the director of finance the sum <br />of one hundred fifty dollars ($150.00) per year. <br /> <br />2. For a license authorizing the sale of malt liquor containing alcohol in excess of three and <br />two-tenths percent (3.2%) by weight and not in excess of five percent (5%) by weight by <br />grocers and other merchants and dealers in the original package direct to consumers but not <br />for resale, the licensee shall pay to the director of finance the sum of twenty-two dollars and <br />fifty cents ($22.50) per year. The phrase "original package" shall be construed and held to <br />refer to any package containing three (3) or more standard bottles of beer. This license shall <br />also permit the holders thereof to sell nonintoxicating beer in the original package direct to <br />consumers, but not for resale. <br /> <br />3. Malt liquor containing alcohol in excess of three and two-tenths percent (3.2%) by weight <br />and not in excess of five percent (5%) by weight, manufactured from pure hops or pure <br />extract of hops or pure barley malt or wholesome grains or cereals and wholesome yeast and <br />pure water may be sold by the drink at retail for consumption on the premises where sold. <br />For every license issued for sale of malt liquor, at retail by the drink for consumption on the <br />premises where sold, the licensee shall pay to the director of finance the sum of fifty-two <br />dollars and fifty cents ($52.50) per year, which license shall also permit the holder thereof to <br />sell nonintoxicating beer as defined in this code. <br /> <br />4. For every license issued for the sale of all kinds of intoxicating liquor, at retail by the drink <br />for consumption on premises of licensee, the licensee shall pay to the director of finance the <br />sum of four hundred fifty dollars ($450.00) per year; however, no license shall hereafter be <br />issued except to: (a) a music school whose principal business is music; and whose primary <br />operating revenue is derived from teaching and performing music; and who has an <br />enrollment of at least 500 students and provides weekly instruction to its students; and who <br />regularly or customarily holds concerts, receptions, recitals, or similar events or gatherings <br /> <br />3 <br />
