<br />INTRODUCED BY: <br /> <br />Mr. Sharpe Jr. <br /> <br />DATE:: 12/12/05 <br /> <br />BILL NO. 8837 <br /> <br />ORDINANCE NO. 6605 <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE UNIVERSITY CITY <br />MUNICIP AL CODE RELATING TO ZONING, BY REPEALING SECTION 34- <br />64.4 THEREOF , RELATING TO TELECOMMUNICATIONS ANTENNAS, <br />TOWERS AND SUPPORT STRUCTURES, AND ENACTING IN LIEU <br />THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 34-64.4 <br />WIRELESS TELECOMMUNICATIONS TOWERS, ANTENNAS, SUPPORT <br />STRUCTURES, AND BUILDINGS OR ENCLOSURES FOR THE POWER <br />AND OPERATING EQUIPMENT OF SUCH FACILITIES;" CONTAINING A <br />SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br />WHEREAS, the University City Plan Commission examined an amendment of Section <br />34.64.4 of the Zoning Code, relating to wireless telecommunications towers, antennas, support <br />structures, and buildings or enclosures for the power and operating equipment of such facilities; <br />and <br /> <br />WHEREAS, the University City Plan Commission, in a meeting at City Hall on October <br />19, 2005, approved said amendment and recommended to the City Council that it be enacted into <br />an ordinance; and <br /> <br />WHEREAS, due notice of a public hearing to be held by the City Council in the City <br />Council Chambers at City Hall at 6:30 p.m. on November 21, 2006, was duly published in <br />the S1. Louis Countian, a newspaper of general circulation within the City on November 4, 2006; <br />and <br /> <br />WHEREAS, said public hearing was held at the time and place specified in said notice, <br />and all suggestions or objections concerning said amendment of Section 34.64.4 of the Zoning <br />Code were duly heard and considered by the City Council. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. Chapter 34 of the University City Municipal Code, relating to zoning, is <br />hereby amended by repealing Section 34.64.4 thereof, relating to telecommunications antennas, <br />towers and support structures, and enacting in lieu thereof a new section to be known as "Section <br />34-64.4 Wireless telecommunications towers, antennas, support structures, and buildings or <br />enclosures for power and operating equipment of such facilities," which shall read as follows: <br /> <br />34-64.4 Wireless telecommunications towers, antennas, <br />support structures, and buildings or enclosures for the <br />power and operating equipment of such facilities* <br />
