The ordinance text remains in the same order as codified in <br />this section. <br /> <br />Purpose and Intent. <br />The purpose and intent ofthis section of the Zoning Code are to: <br /> <br />a. Enact appropriate regulations, in accordance with the U. S. Telecommunications <br />Act of 1996, for the provision of personal wireless service facilities in University <br />City, Missouri; <br /> <br />b. Establish standards to regulate the placement and design of wireless <br />communications facilities so as to preserve the well-being of the community; to <br />assure compatibility with properties adjacent to such facilities; to minimize adverse <br />effects, including discordant visual impacts, with the intent of protecting the <br />general safety, welfare, and quality of life of the City; <br /> <br />c. Encourage the leasing of municipally owned properties, where feasible or <br />desirable, if an additional location is sought for the development of a wireless <br />communications facility; <br /> <br />d. Allow wireless communications facilities to be located according to <br />demonstrated need; encourage the use of existing facilities, including co-location <br />by multiple companies; encourage the placement of antennas if needed on existing <br />structures; and encourage the use of smaller, less obtrusive facilities such as <br />repeaters and microcell facilities where they are feasible alternatives to base station <br />facilities; <br /> <br />e. Locate wireless communications facilities within non-residential zoning districts, <br />according to a preferential ordering within zoning districts, with an intent of <br />minimizing the impacts of such facilities upon neighboring land uses, except as <br />otherwise provided in this Section; <br /> <br />f. Require all wireless communications facilities to be consistent with all applicable <br />City of University City Municipal Code provisions, applicable regulations and <br />standards of other governmental agencies, and any applicable discretionary permits <br />affecting the subject property except to the extent the City Council shall modify <br />such requirements. <br /> <br />1. Requirements for Conditional Use Permits. <br /> <br />a. Applications for conditional use permits. These shall be filed and processed in <br />accordance with Article 11.
