<br />b. Inspection and Repair: After a damaging event. The operator shall authorize an <br />inspection of the structural integrity of the tower or disguised support structure and <br />the antenna itself following a tornado within five miles of the city limits; or <br />following an earthquake in the greater St. Louis metropolitan area with a <br />magnitude of 5.5 or greater on the Richter scale; or following other events covered <br />by the repair bond, per Subsection 2j above, within thirty days of such events. In <br />the event that structural damage is found, the operator shall repair such damage <br />within an additional thirty days of such events. The applicant's surety bond shall <br />cover the expense of repairing of the damage per Subsection 2j for the city if <br />repairs are not arranged by the applicant within the time limit. Certification of the <br />inspection and repairs, if any, shall be sent in a report to the City Manager within <br />an additional thirty days. <br /> <br />8. Certification of Facilities. <br /> <br />a. No wireless communications facility or combination of facilities shall at any <br />time produce power densities that exceed the Federal Communications <br />Commission's limits for radiofrequency strength and power density for <br />transmitters. In order to ensure continuing compliance with all applicable <br />emission standards, an approved engineer shall review the schedule and procedures <br />of the wireless communications facility. <br />(1) Within forty-five (45) days of initial operation or modification of a <br />telecommunications facility, the owner or operator of such facility shall <br />submit to the Zoning Administrator a written report by a City-approved <br />engineer that the facility's radio frequency radiation levels are in <br />compliance with the approved application and any federal or state <br />regulations. The report shall include measurements of the radiofrequency <br />radiation power levels. If the report shows that the facility does not <br />comply with applicable FCC regulations, the owner or operator shall cease <br />operation of the facility until the facility complies with, or has been <br />modified to comply with, the FCC regulations. Proof of compliance shall <br />be a certification provided by the engineer who prepared the original <br />written report. In order to assure the objectivity of the analysis, the City <br />may require, at the owner's expense, independent verification of the results <br />of the analysis. <br /> <br />(2) If the Zoning Administrator at any time finds that there is good cause <br />to believe that a wireless communications facility is not in compliance <br />with applicable FCC radiofrequency radiation exposure limits, he/she may <br />require the operator to submit written certification by an approved <br />engineer that the facility is in, or has been brought into, compliance with <br />such FCC regulations, within 30 days of notification. <br /> <br />b. All reasonable costs of such inspections shall be borne by the owner or <br />operator of the facility. The City may require, at the operator's expense, <br />independent verification of the results of any analysis. <br /> <br />13 <br />
