<br />INTRODUCED BY: Mr. Wagner <br /> <br />DATE: <br /> <br />June 26, 2006 <br /> <br />BILL NO.: 8890 <br /> <br />ORDINANCE NO.: 6652 <br /> <br />AN ORDINANCE AMENDING CHAPTER 6.04 OF THE UNIVERSITY CITY <br />MUNICIP AL CODE, RELATING TO ANIMALS GENERALLY, BY REPEALING <br />SECTION 6.04.025 THEREOF, RELATING TO CHICKENS-PERMIT REQUIRED, <br />AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 6.04.025 CHICKENS - PERMIT REQUIRED", THEREBY AMENDING <br />SAID SECTION SO AS TO PROHIBIT THE ISSUANCE OF ANY NEW PERMIT <br />FOR A PERIOD OF ONE YEAR, PROHIBIT THE SALE OF CHICKENS OR EGGS, <br />REQUIRE QUARTERLY INSPECTIONS OF PREMISES WHERE A CHICKEN IS <br />KEPT, AND SPECIFY A MINIMUM FINE FOR KEEPING A CHICKEN WITHOUT <br />A PERMIT; CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br />Section 1. Chapter 6.04 of the University City Municipal Code, relating to animals <br />generally, is hereby amended by repealing Section 6.04.025 thereof, relating to chickens- permit <br />required, and enacting therein a new section to be known as "Section 6.04.025 Chickens- Permit <br />Required," so that said section, as so amended, shall read as follows: <br /> <br />6.04.025 Chickens - Permit Required. <br /> <br />A. Unlawful. It shall be unlawful for any person to keep, maintain or allow to remain <br />upon any lot, tract or parcel of ground within the City a chicken, unless a permit to do so is <br />issued as provided in this section or is allowed under Section 6.04.020. Any person violating <br />any of the provisions of this subsection shall, upon conviction thereof, be fined a sum not less <br />than two hundred dollars ($200.00) per chicken that is in violation thereof. <br /> <br />B. Permits. The Director of Public Works is authorized to administer chicken permits, <br />and to adopt and promulgate rules and regulations to interpret and implement the provisions of <br />this section to secure the intent thereof and to promote the public health, safety and general <br />welfare. An application for a chicken permit shall be submitted to the Director of Public Works, <br />accompanied by a non-refundable application fee in the amount of fifty dollars ($50.00) payable <br />to the City. No permit shall be issued for more than seven (7) hen chickens on any platted lot or <br />group of contiguous lots, parcels, or tracts of land, and no permit shall be issued for a rooster. A <br />permit shall expire one (1) year after issuance. No more than five (5) permits shall be in effect in <br />the City at anyone time. No new permit shall be issued during a one-year period, which shall <br />commence upon the passage of this ordinance. <br /> <br />C. Confinement. A chicken shall at all times be safely and securely confined in a coop or <br />other enclosure at least sixteen (16) but not more than thirty-two (32) square feet. The coop or <br />other enclosure shall provide sufficient rain shelter and at least two (2) linear feet of roosting <br />space per chicken, and shall be located in the rear yard and at least ten (10) feet from the <br />property line. A diagram that indicates the location of the coop or other enclosure, its size and <br />distance from the property lines and other structures on the property, shall be included with the <br />
