<br />chicken permit application. The coop or other enclosure shall be maintained in good repair, free <br />of noxious odors, and in a clean and sanitary condition. <br /> <br />D. Nuisances. No chicken shall be allowed to create a nuisance, or disturb neighboring <br />residents due to noise, odor, damage or injury. <br /> <br />E. Sale of Chickens or Eggs. No chicken kept on premises pursuant to a chicken permit <br />or any egg produced by such a chicken shall be sold or offered for sale, including but not limited <br />to by barter or exchange. <br /> <br />F. Inspections. The Director of Public Works or his or her designee shall inspect at least <br />once every three (3) months the premises where any chicken is kept, to determine whether there <br />is compliance with this section. There shall be a twenty-five dollar ($25.00) fee per inspection, <br />which the chicken permit holder shall pay to the City. <br /> <br />G. Responsibility. The owner and occupant of premises where a chicken is kept, <br />maintained or allowed to remain, and any holder of a permit for the chicken, shall be responsible <br />for any violations of this section. <br /> <br />Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Section 6.04.025, nor bar <br />the prosecution of any such violation. <br /> <br />Section 3. Any person, firm or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, <br />Section 1.12.010 of the University City Municipal Code. <br /> <br />Section 4.
