C. Violation. It is unlawful for any vehicle to be operated in violation of a traffic control signal at an intersection listed in subsection B, including but not limited to the execution of a right turn on a red signal where prohibited. D. Liability. Both the owner and operator of any vehicle operated in violation of a traffic control signal at an intersection listed in subsection B shall be liable under this section for such violation; provided, however: 1. The owner of a vehicle shall not be liable if the vehicle was being used without the owner's permission, but the owner shall have the burden of injecting the issue and shall have the burden of persuasion that the defense is more probably true than not. 2. The owner-lessor of a vehicle shall not be liable when the vehicle is being permissively used by a lessee if the owner-lessor furnishes the name, address and operator's license number of the person renting or leasing the vehicle at the time the violation occurred to the City within three working days from the time of receipt of a written request for such information. Any owner-lessor who fails or refuses to provide such information within the period required by this subsection shall be liable for the imposition of the fine established in this section. E. Enforcement Procedures. Upon review of a Recorded Image(s) showing a violation of subsection B and any additional information, a law enforcement officer may complete a citation, a copy of which shall be mailed along with a copy of the Recorded Image(s) to the Owner at the Owner's last known address by United States mail, postage prepaid, as soon as practicable but in no event more than thirty (30) days after the Recorded Image(s) was taken. In all other respects, the prosecution and disposition of a violation of this section shall be according to Missouri Supreme Court Rule 37. Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Chapter 10.32 of the University City Municipal Code, nor bar the prosecution for any such violation. Section 3. Any person, firm, or corporation violating any of the provisions of this ordinance shall, upon conviction thereof, be subject to a penalty which shall be a fine in an amount not to exceed one hundred dollars ($100.00). Section 4. This ordinance shall take effect and be in force from and after its passage as provided by law.
