<br />C. Violation. It is unlawful for any vehicle to be operated in violation of a <br />traffic control signal at an intersection listed in subsection B, including but not <br />limited to the execution of a right turn on a red signal where prohibited. <br /> <br />D. Liability. Both the owner and operator of any vehicle operated in <br />violation of a traffic control signal at an intersection listed in subsection B shall be <br />liable under this section for such violation; provided, however: <br /> <br />1. The owner of a vehicle shall not be liable if the vehicle was being used <br />without the owner's permission, but the owner shall have the burden of <br />injecting the issue and shall have the burden of persuasion that the <br />defense is more probably true than not. <br /> <br />2. The owner-lessor of a vehicle shall not be liable when the vehicle is being <br />permissively used by a lessee if the owner-lessor furnishes the name, <br />address and operator's license number of the person renting or leasing <br />the vehicle at the time the violation occurred to the City within three <br />working days from the time of receipt of a written request for such <br />information. Any owner-lessor who fails or refuses to provide such <br />information within the period required by this subsection shall be liable for <br />the imposition of the fine established in this section. <br /> <br />E. Enforcement Procedures. Upon review of a Recorded Image(s) <br />showing a violation of subsection B and any additional information, a law <br />enforcement officer may complete a citation, a copy of which shall be mailed <br />along with a copy of the Recorded Image(s) to the Owner at the Owner's last <br />known address by United States mail, postage prepaid, as soon as practicable <br />but in no event more than thirty (30) days after the Recorded Image(s) was <br />taken. <br /> <br />In all other respects, the prosecution and disposition of a violation of this <br />section shall be according to Missouri Supreme Court Rule 37. <br /> <br />Section 2. This ordinance shall not be construed so as to relieve any <br />person, firm or corporation from any penalty heretofore incurred by the violation <br />of Chapter 10.32 of the University City Municipal Code, nor bar the prosecution <br />for any such violation. <br /> <br />Section 3. Any person, firm, or corporation violating any of the <br />provisions of this ordinance shall, upon conviction thereof, be subject to a penalty <br />which shall be a fine in an amount not to exceed one hundred dollars ($100.00). <br /> <br />Section 4. This ordinance shall take effect and be in force from and <br />after its passage as provided by law. <br />
