<br />Section 5.100.060 License Revocation <br /> <br />A. The director may revoke a news box license may for a <br />period of time not to exceed one (1) year for any of the following <br />occurrences: <br /> <br />(1) Fraud, misrepresentation, or any false <br />statement contained in the application for a license; <br /> <br />(2) More than three (3) violations of any provision <br />or condition of the license granted to the distributor over a period of <br />one (1) or more years; or <br /> <br />(3) More than three (3) violations of any provision <br />of this chapter over a period of one (1) or more years. <br /> <br />B. A news box license may be revoked only after a <br />hearing is conducted by the director. The distributor shall be given <br />at least fifteen (15) days prior written notice of the hearing. The <br />director, after hearing all interested parties, shall make a <br />determination whether one (1) or more of the above referenced <br />conditions has occurred and issue an order supported by the <br />information presented at the hearing. If the news box license is <br />revoked, the distributor may reapply after the expiration of the <br />revocation time period. <br /> <br />Section 5.100.070 Miscellaneous Regulations <br /> <br />A. All news boxes located within the public right-of-way <br />prior to the effective date of the amendment shall be licensed and <br />brought into compliance with all provisions of this chapter or be <br />removed by the distributor within ninety (90) days of the effective <br />date of this article. <br /> <br />B. If a news box remains empty or the printed material is <br />not changed in accordance with its regular publishing schedule for <br />a period of thirty (30) consecutive days, the news box shall be <br />deemed abandoned. <br /> <br />C. The director is authorized to seize any unlicensed or <br />abandoned news box, any news box for which the license has been <br />revoked, and any otherwise non-compliant news box using the <br />procedures set forth in Section 5.04.230; provided, however: <br />
