<br /> <br /> <br /> INTRODUCED BY: Mr. Wagner DATE: June 15, 2009 <br /> <br /> <br /> <br /> BILL NO. 9042 ORDINANCE NO. 6788 <br /> <br /> <br /> AN ORDINANCE AMENDING CHAPTER 8.12 OF THE UNIVERSITY CITY <br /> MUNICIPAL CODE, RELATING TO SOLID WASTE MANAGEMENT AND <br /> DISPOSAL, BY REPEALING SECTION 8.12.120 THEREOF, RELATING TO <br /> TYPES OF SOLID WASTE CONTAINERS - REPLACEMENT, AND ENACTING <br /> IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 8.12.120 <br /> TYPES OF SOLID WASTE CONTAINERS - REPLACEMENT"; THEREBY <br /> AMENDING SAID SECTION SO AS TO AUTHORIZE THE DIRECTOR OF <br /> FINANCE TO ESTABLISH, IMPOSE AND ASSESS A FEE THAT REFLECTS <br /> THE TOTAL COST OF REPLACING SOLID WASTE CONTAINERS; <br /> CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, the City Council desires to provide appropriate solid waste containers to <br /> property owners benefiting from the City's solid waste collection services without them <br /> incurring a substantial fee at the time of replacement; and <br /> <br /> WHEREAS, the fee authorized by this ordinance is designed and intended to recoup the <br /> City's costs for the provision of these services, and the City Council finds and determines that <br /> the fee is reasonable and necessary for such recoupment and will reflect the actual value of the <br /> services so rendered. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 8.12 of the University City Municipal Code, relating to solid waste <br /> management and disposal, is hereby amended by repealing Section 8.12.120 thereof, relating to <br /> types of solid waste containers - replacement, and enacting in lieu thereof a new section to be <br /> known as "Section 8.12.120 Types of solid waste containers - Replacement", so that said <br /> section, as so amended, shall read as follows: <br /> <br /> 8.12.120 Types of solid waste containers - Replacement. <br /> <br /> A. One to Two Family Residential Buildings. For one and two family buildings, <br /> roll-out plastic carts shall be provided for said waste storage and collections, except where <br /> collections are from the alley. Carts shall have a capacity of either sixty (60) or ninety (90) <br /> gallons or other size as designated by the director of public works. The use of sixty (60) gallon <br /> carts shall be limited to units occupied by no more than two persons, one of whom is at least <br /> sixty five (65) years of age. Carts shall have wheels, handles, and a hinged, tight-fitting lid <br /> capable of containing solid waste and reducing odors, and shall be compatible with existing city <br /> equipment for mechanical lifting and dumping. Carts shall weigh, with contents when full, not <br /> in excess of two hundred (200) pounds. Mechanical box-type containers shall be used for alley <br /> collections or where permitted by the director of public works. <br />
