<br /> <br /> <br /> <br /> B. Three to Four Family Residential and Non-Residential Buildings. For three- <br /> family and four-family residential buildings, and for non-residential buildings, solid waste shall <br /> be stored in a mechanical box-type container or containers. Mechanical box-type containers <br /> shall (1) have a capacity of one and one-half cubic yards or greater, (2) have a hinged, tight- <br /> fitting lid capable of containing solid waste and reducing odors, and (3) be equipped with lugs <br /> and brackets, permitting city sanitation trucks or private contract haulers to mechanically pick up <br /> and remove the content. Roll-out plastic carts may be used for three-family and four-family <br /> residential buildings where permitted by the director of public works. <br /> <br /> C. Public solid waste containers may be placed in public places, and the placement <br /> of, and collection of solid waste from said containers shall be as authorized by the director of <br /> public works. Public solid waste containers placed on city sidewalks, streets, parks and other <br /> public places shall be used only for such solid waste as persons may have for disposal while <br /> passing along the streets or using the city's parks or other public places. Such containers shall <br /> not be used for the disposal of solid waste accumulated in residences or places of business. <br /> <br /> D. The director of finance shall establish, impose and assess against all property <br /> owners benefiting from the City's solid waste collection services, a fee reflecting the total cost of <br /> replacing roll-out plastic carts, recyclables containers, and dumpsters, and may adjust the fee <br /> from time to time as necessary. The fee shall be in addition to the solid waste collection fee <br /> established and imposed by the City Council pursuant to Section 8.12.200.A, but shall be <br /> deemed a solid waste collection service fee for billing, collection, enforcement and all other <br /> purposes in Article III of this Chapter. All fees collected by the finance director pursuant to this <br /> subsection shall be deposited in a fund and used solely for replacing roll-out plastic carts, <br /> recyclables containers, and dumpsters. <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br /> corporation from any penalty heretofore incurred by the violation of Chapter 8.12, Section <br /> 8.12.120, nor bar the prosecution of any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provisions of thi s <br /> ordnance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1. 12, <br /> Section 1. 12.010 of the University City Municipal Code. <br /> <br /> Section 4.
