<br /> <br /> <br /> <br /> <br /> <br /> INTRODUCED BY: Mr. Crow DATE: April 12, 2010 <br /> <br /> <br /> BILL NO.: 9069 ORDINANCE NO.: 6812 <br /> <br /> <br /> AN ORDINANCE AMENDING CHAPTER 9.20 OF THE <br /> UNIVERSITY CITY MUNICIPAL CODE, RELATING TO <br /> OFFENSES BY OR AGAINST MINORS, BY REPEALING <br /> SECTION 9.20.010 THEREOF, RELATING TO ENDANGERING <br /> THE WELFARE OF A CHILD, AND ENACTING IN LIEU THEREOF <br /> A NEW SECTION TO BE KNOWN AS "SECTION 9.20.010 <br /> ENDANGERING THE WELFARE OF A CHILD", THEREBY <br /> AMENDING SAID SECTION SO AS TO INCORPORATE <br /> CHANGES IN STATE LAW; CONTAINING A SAVINGS CLAUSE <br /> AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br /> CITY, MISSOURI, AS FOLLOWS: <br /> Section 1. Chapter 9.20 of the University City Municipal Code, relating to <br /> offenses by or against minors, is hereby amended by repealing Section 9.20.010 thereof, <br /> relating to endangering the welfare of a child, and enacting in lieu thereof a new section <br /> to be known as "Section 9.20.010 Endangering the welfare of a child," thereby amending <br /> said section so as to incorporate changes in state law; so that said section, as so amended, <br /> shall read as follows: <br /> <br /> 9.20.010 Endangering the welfare of a child. <br /> <br /> A. A person commits the ordinance violation of endangering the welfare of a <br /> child if. <br /> 1. He or she with criminal negligence acts in a manner that creates a substantial risk to <br /> the life, body or health of a child less than seventeen (17) years old; or <br /> 2. He or she knowingly encourages, aids or causes a childless than seventeen (17) years <br /> old to engage in any conduct which causes or tends to cause the child to come within the <br /> provisions of paragraph (d) of subdivision (2) of subsection 1 or subdivision (3) of <br /> subsection 1 of Section 211.031 RSMo; or <br /> 3. Being a parent, guardian or other person legally charged with the care or custody of a <br /> child less than seventeen (17) years old, he or she recklessly fails or refuses to exercise <br /> reasonable diligence in the care or control of such child to prevent him or her from <br /> coming within the provisions of paragraph (c) of subdivision (1) of subsection 1 or <br /> paragraph (d) of subdivision (2) of subsection 1 or subdivision (3) of subsection 1 of <br /> Section 211.031 RSMo; or <br /> 4. He or she knowingly encourages, aids or causes a child less than seventeen (17) years <br /> old to enter into any room, building or other structure which is a public nuisance as <br /> defined in Section 195.130 RSMo; or <br />
