He or she operates a vehicle in violation of subdivision (2) or (3) of subsection 1 of <br /> Section 565.024 RSMo, subdivision (4) of subsection 1 of Section 565.060 RSMo, <br /> Section 577.010 RSMo, or Section 577.012 RSMo, while a child less than seventeen (17) <br /> years old is present in the vehicle. <br /> B. Nothing in this section shall be construed to mean the welfare of a child is <br /> endangered for the sole reason that he or she is being provided nonmedical remedial <br /> treatment recognized and permitted under the laws of this State. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm <br /> or corporation from any penalty heretofore incurred by the violation of Chapter 9.20, <br /> Section 9.20.010, nor bar the prosecution for any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provisions of this <br /> ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter <br /> 1. 12, Section 1. 12.010 of the University City Municipal Code. <br /> <br /> Section 4.
